All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Golowka http://www.genrecords.net/emailregistry/vols/00012.html#0002972 May 16, 2025, 11:50 pm Source: Estate Case Files, Dawson Joel P Repeated - Dejarnette Kathleen, 1800-1915 Written: May 20, 1859 Recorded: November 27, 1865 Page 1 In the name of God Amen: I Frances Dejarnett of the county of Autauga and state of Alabama, being in bad health and weak of body, but of sound + disposing mind and memory – and being mindful of my mortality, and the uncertainty of life, do make and ordain the following as my last will + testament in manner and form following, to wit: Item 1 I commend my soul to God who gave it, trusting in the merit of the Savior for salvation, through his grace and ? and as to my worldly affairs I dispose of as follows: Item 2d I five devise and bequeath the houses and lots in Autaugaville containing about four acres, where I now reside with my husband Wm P Dejarnette, together with all the lands I now own at our old summer place in the Hills containing about 200 acres ? also all my parlor furniture to my seven children, viz John P Dejarnett, Archibald McB Dejarnett, James T Dejarnett, Mumford Dejarnett, Napoleon Dejarnett, Francis W Dejarnett + William F Dejarnett, equally to be divided share + share and share alike with this condition and provision, that my said husband Wm P Dejarnett, is to retain possession of said house + lots and lands in the hills and use + occupy + enjoy the same with our said children above named free of rent or charge during the time he may remain unmarried after my death, and after his death or marriage then to be sold by my Executor hereinafter appointed + the proceeds equally divided among Page 2 my children herein before named. Item 3d It is my will + desire and I hereby authorize my said husband Wm P Dejarnett to sell or dispose of my said house + lots within named and also the land in the Hills as also the parlor furniture in the event that he should remove from this county or town with our children and he is authorized to invest the proceeds of same in land or negroes for the benefit of our said children to be held in the said manner + upon the same condition as specified in the 2nd item. Item 4th I give devise + bequeath the Two Hundred Dollars now loaned to my sister Eliza Dejarnette to my two youngest sons Wm Francis and Francis W Dejarnett + in case one should die then the one half of its share shall go to my sons Napoleon + Mumford Dejarnett and in case both of my youngest sons should die before arriving at the age of 21 then to go to + vest in my two youngest sons then living. Item 5 I give devise + bequeath my gold watch to my son James T Dejarnett when he arrives at the age of 17[?} years. Item 6 I hereby nominate constitute and appoint my husband Wm P Dejarnett my Executor, to carry out this my will and I do not wish any bond or security from him as such. In witness whereof I the said Francis Dejarnett have hereunto set my hand and seal this 20th day of May AD 1859. McNeill The State of Alabama Autauga County I G W Benson Judge of the Court of Probate in and for said county and state do hereby certify that the within instrument of writing has this day in said court once before me as the Judge thereof been duly proven by the proper testimony to be the genuine last will and testament of Fanny DeJarnette deceased and that said will together with said proof thereof have been recorded in my office in Book of Probate[?} wills No 15 pages 93, 94 & 95 In witness of all which I have hereto set my hand and seal of the said court this November 27t 1867 G W Benson Judge The State of Alabama Autauga County Probate Court of said County In the matter of the Probate of the last will and testament of Fanny DeJarnette ded. Before me G W Benson Judge of the said Court, personally appeared in open Court Duncan McNeill who having been by me first duly sworn and examined, did and does depose and say, on oath, that he is a subscribing witness to the instrument of writing now shown to him and which purports to be the lase will and testament of Fanny DeJarnette deceased late and inhabitant of this county, that said Fanny DeJarnette since deceased signed and executed said instrument on the day the same bears date and declared the same to be her last will and testament and that affiant set his signature thereto on the day the same bears date and that affiant together with Thomas F Greene and Wm N Thompson set their signatures thereto on the day the same bears date as subscribing witnesses to the same in the presence of the said testatrix, and in the presence of each other at the request of said testatrix. That said testatrix was of sound mind and disposing memory and in the opinion of deponent fully capable of making her will at the time the same was so made as aforesaid. Affiant further states that said testatrix was on the day of the date of said was of the full age of twenty one years and upwards. Sworn to + subscribed before D McNeill In open Court this 27th Day of November 1865 G W Benson Judge Additional Comments: Frances McBryde Dejarnette, aka Fanny, daughter of Archibald McBryde & Lydia Ramsey, married William Pickett Dejarnette on 3 September 1831 in Autauga County, Alabama. They had at least 9 children, with seven named in the will. The two that died were Mumford Archibald Dejarnette (1832-1833) and Owen Dejarnette (1842-1843).
