X We the undersigned having been appointed appraisers of the Estate of Edmund Franklin Dec’d do hereby Value and Appraise the above Articles shown to us as the whose Estate of the said Edmund Franklin by the Administratrix agreeable to the sums thereto affixed amounting to five hundred & one dollars subject to the claim of Mark Franklin as also stated. Silvester Bill Judge OCBC ------------- STATE OF ALABAMA} Baldwin County } Know all men by these presents, that we Mary Franklin, Gerald Byrne & Robert Kilcreas are held and firmly bound unto Silvester Bill, Judge of the Orphans’ Court of the County aforesaid, in the sum of six hundred Dollars to be paid to the said Judge or his succefsors in office, to which payment well and truly to be made, we bind ourselves, our heirs, executors and administrators, jointly, severally and firmly, by these presents. Sealed with our seals, and dated this 20th day of Jany one thousand eight hundred and twenty-four. The condition of the above Obligation is such, That whereas the above bound Mary Franklin has been duly appointed ad- ministratrix of all and singular the goods and chattels, rights and credits, of Edmund Franklin, deceased. Now if the said Mary Franklin shall well and truly perform all the duties which are, or may be by law, required of her as such administratrix then the above obligation to be void, otherwise to remain in full force. The Judge of Baldwin County } the County Court of Baldwin County The petition of Mary Franklin humbly showest that she is administratrix of the Estate of Edmund Franklin Dec’d & that whereas your petitioner as administratrix aforesaid had/has? __ and pofsefsed [possessed] of certain land Patents (the lands being situated in the Country of Arkansas in the tract appropriated by act of Congress for Military bounties) of the following numbers 22111, 23162, 22644, 23920, 24794, 24103, 24105, 23352 there being Eight in the whole and all containing One Hundred and Sixty acres each, value in the appraisment of said Estate at Thirty five dollars each. And as there is not enough of the property to pay the debts of the late Deceased, your Petitioner therefore prays an order of your Honorable Court authorizing her to sell the aforesaid Land Patents for the purpose of paying said debts and your petitioner also duty bound will now pray(?) Sworn to before me } This 27th Nov 1824 } Robert Killcreas Silvester Bill} Additional Comments: Mary Franklin: Her relationship to Edmond (Edmund) uncertain, but due to the manner in which legal proceedings were handled at that time, she was most likely his wife. A sister would not have been named administratrix of the estate, particularly with his brother living in the same county. Mark Franklin: Brother of Edmond (Edmund) Franklin Robert Killcreas: Attorney in fact for Mary Franklin The second appraiser is Lazarus J Bryers found aged 20-30 on sheet 39 page 30 of the 1830 Baldwin County Census. Gerald Byrne is a relative of Judge Patrick Byrne of Baldwin County, AL Uriah Blue on the 1830 Baldwin Co, AL census sheet 43 page 22 line 18.
