After my decease, it is my wish that my body be decently interred and all my just {debts} paid. I bequeath and divise to my beloved wife Ida Cummins Stapleton, all the estate I am possessed of at the time of my decease of every kind, nature, and description both real, personal and mixed. It is my desire and wish that my said wife shall be appointed as administrator of my estate and that she shall not be required to give any bond for the performance of said duties as said administratrix. Witness my hand and seal this fourteenth day of October AD 1901, at Daphne Alabama. Signed, sealed & pub- lished in presence of Frank S Stone } George B Bryant } David Crockett Stapleton Walter Cummins } We Frank S Stone and George B Bryant and Wat Cummins, the the witnesses to the foregoing will of David Crockett Stapleton, hereby certify that we signed the same at the request of David Crockett Stapleton in his immediate presence and in the immediate presence of each other, on the day the same be date, and being this October fourteenth AD 1901 The State of Alabama Baldwin County Probate Court In the matter of the Probate of the last will and testament of David Crockett Stapleton deceased. Before me J H H Smith, Judge of said Court person ally appeared in open Court Frank S Stone who having been by me first duly sworn and examined did and do depose and say on oath that he is a subscribing witness to this instrument of writing now shown to him and which purports to be the last Will and Testament of David Crockett Stapleton deceased late an inhabitant of this County that said David Crockett Stapleton since deceased signed and executed said instrument on the day the same bears date and declared the same to be his last Will and Testament and that offiant set his signature thereto, on the day he same bears date, as a subscribing witness to the same in the presence of said David Crockett Stapleton and at his request and that such other witness subscribed his name as a witness in his presence and in the presence of said David Crockett Stapleton. That said David Crockett Stapleton was of sound mind and dispos- ing memory, and in the opinion of deponent, fully capable of making his will at the time the same was so made as aforesaid. Affiant further states that said David Crockett Stapleton was on the day of the date of said will of the full age of twenty one years and upward. Smith Judge Probate The State of Alabama } Baldwin County }I, J H H Smith, Judge of Probate Court in and for said County and State, hereby certify that the within instrument of writing has this day in said Court and before me as the Judge thereof been duly proven by the proper testimony to be the genuine last will and testament of David Crockett Stapleton deceased, and that said will together with the proof thereof have been recorded in my office in Book "B" of Wills at pages 160-161. Smith Judge of Probate Court Additional Comments: Note: Walter L Cummings (Cummins) b Dec 1865 aged 35 was one of 2 boarders in 28/28 David C Stapleton & Ida on the 1900 Baldwin Co, AL census. He was Ida’s brother. Frank S Stone 36 was a lawyer 17/17 Baldwin Co, Al census. David Crockett was the son of Solomon Stapleton & Elizabeth A White (found on Baldwin Co, AL census records from 1840-1880). David is found on the following Baldwin Co, AL census records with his parents: 1840, 18 Nov 1850 in household 383/383 & 23 Jun 1860 in household 479/370. David & 1st wife, Sarah E Overton, are in household 2/2 Baldwin Co, AL 1 Jun 1870 (they married 10 Oct 1860 in Baldwin Co, AL). 10 Jun 1880, he & 2nd wife(?), Rose, are in 209/219 Tatumville (now Fairhope). 14 Jun 1900 finds David with 3rd wife, Ida, in 28/28 Pct 7, District 5 Courthouse, Montrose, Baldwin Co, AL (they married 29 Apr 1895 in Baldwin Co, AL.) Ida Cummins was the daughter of James St. John Cummins & Caroline Davis Taber, who were enumerated both in Ward 2 & Ward 6 of Mobile in 1860. I have this family on census records in Mobile thru 1880 (didn't look any farther).
