Thornton County Probate Office, Clayton, AL Orphans Court Record book Pages 124-127. Know all men by these merits that I Green H. Thornton of the County of Barbour and state of alabama being os sound mind and diposing memory do make publish and delclare the following to be my last will and testament hereby revoking all wills that may have heretofore been made by me. Item 1. I will and devise that my mortal remains be interred in a decent manner and that as soon as practicable thereafter a scent box tombstone be erected thereupon and it enclosed with aninon railing. 2nd. After the payment of all my lawful debts by my executors herin after appointed, I give bequeth and desire unto my beloved wife Rhoda Thornton (should she survive me) my plantation known as the Home Place containing four hundred and eighty acres of land together with all the appisterrances thereinto affiised and all the stock, furniture, farming utensils, vehicles and other personal property that is in on upon said plantation in keeping it up and provisions of every kind sufficient to support and keep up the plantation for one year, that is to finish or make one crop as the case may be, for her natural life and no longer free from the control of any one. Only that my executors herein after mentioned are auhtorized and directed to exercise a supervising can of said life estate and prevent waste but in manner to deprive her after full control and free thereof during her life. 3rd. I bequeath and devise unto my wife Rhoda absolutely and forever all the (such) profits that she may make out of said estate during her life interest free to dispose of as she may see fit by will or other (in). 4th. The remainder of my property both real and personal and mixed which consist of plantation stock, for (pitine?) farming utensils and a store house and lot in the city of Eufaula, I hereby give bequeath and devise unto my six children or their heir in equal shares that is one share to the children of my son Leander A. Thornton in equal shares, one shre or one sixth to R.B. Thornton, one share to G.G. Thornton, One share to N.H. Thornton and one share to the children of my deceased daughter Euphemy Cartledge formerly Euphemy Thornton in equal parts, and one share to my daughter Rhoda Cartledge formerly Rhoda Thronton, upon the ocntition that the one sixth or one share conveyed to the children of my son Leander A. Thornton shall be free from Leanders debts now exitsting or hereafter contracte, and free and protected from the debts of any other person but should the said Leander be endebted to me at the time of my death then said endebteding shall be considered as an advancement to his children and shall be liquidated by deducting that amount from their share in eqaul parts. And I hereby make and constitute Leander A. Thornton the trustee of said estate for his children during their minority. 5th. I hereby make constitute and appoint my son R.B. Thornton trustee of the estate heretofore conveyed to the children of my deceased daughter Euphemy Cartledge during their minority. 6th. Should my son Dozier Thornton whom we suppose was killed during the late war hereafter appear among the living then the forgoing will is so far revoked as to entitle him to an equal share with the other children. 7th. As soon after my death as practicable it is my will and dirction that my estate be diveded as heretofore conveyed and sale made if (wicufary) and as the legatees are all of age their parts given them as soon as lawful. 8th Upon the death of my wife I hereby bequeath and devise to my children aforesaid or their heir in equal parts to my children that is the children of any one of my deceased children taking a childs share the life estate heretofore bequethed to my wife. 9th I have in my possession a note signed by Edmund Cartledge (now) deceased for 10,000 lbs of cotton given for one half interest in the land upon which his widow my daughter Rhoda now lives. If said note is not paid during my life it is my will and devisition that it be given by me exectuors to my duaghter Rhoda or her heirs for one thousand dollars to be decucted from her share and it is my will that she remain undestrbed in the (topipion) therof until her title can be perfected as above deducted. 9th I hereby make contitute and appoint my sons R.B. Thornton and N.H. Thornton the executors of this my last will and testament in writing whereof I have hereunto set my hand and seal this the 13th day of October AD 1865. Green H.
