J, 1863 – 1876, Pp 79 -81 Written: September 28, 1869 Recorded: November 19, 1869 State of Alabama, Bibb County Being mindful of my mortality and now being weak in body but of Sound and disposing mind, I make, publish and declare this to be my last will and testament, hereby declaring and making void all other wills by me at any time heretofore made. 1st I resign my Soul to God who gave it and my body to the dust to be buried in a decent and Christian like manner and as the little property that it pleased God to bless me with, I dispose of in the following manner. I have given off to my children viz. Anna Harpole, W. V. Arnold, Prestley B. Arnold, James W. Arnold, F. M. Arnold and to William Arnold in his life time and to Frances Rottenberry horses hogs cattle and other property as equally as I could all of which has been delivered to them. I have lately delivered to Frances L. Rottenberry one young sorrel horse with a blaze in his face and one cow and calf which I have lately delivered to her in her own right as her separate estate and to the heirs of her body. And as my real estate and the personal property that I now have or may die seized and possessed of—I give and bequeath to my beloved wife Charlotte Arnold during her natural life. And I request my sons to manage the lands and other property for the benefit and support of my wife during her life time. And I also request them to see that their mother is well provided for during her lifetime. And at her death I will and desire that my land and all other property of whatsoever nature it may consist to be sold by my Executors and to be equally divided among my children, viz-Anna Harpole, W. V. Arnold, Prestley B. Arnold, James W. Arnold, F. M. Arnold, Frances L. Rottenberry and the children of William Arnold deceased. I hereby nominate, constitute and appoint my son Wiley V. Arnold my sole executor of this my last will and testament. And again request him to see that his mother is well provided for during her natural life—In witness whereof I hereunto set my hand and affix my seal this the 28th day of September, A. D. 1869. Jones The State of Alabama Bibb County In the Probate Court of said County. In the matter of the Probate of this will and testament of Wyatt H. Arnold late of said County, deceased, Before me, Jackson Gardner, Judge of the said Probate Court of said County personally appeared in open Court Greenville Jones & T. J. Jones who having been by me first respectively duly sworn & examined did & do dispose and say on oath that they are such subscribing witnesses to the instrument of writing now shown to them & which purports to be the last Will & Testament of Wyatt H. Arnold deceased late an inhabitant of Said County. that said Wyatt H. Arnold since deceased Signed & Executed said instrument on the day the same bearing date and declared the same to be his last will & testament & that they the said Greenville Jones & T. J. Jones signed their names to said instrument of writing on the day the same bears date as subscribing witnesses to the same in the presence of said testator and at his request. That said testator was of sound mind & disposing memory & in the opinion of deponents fully capable of making his will at the time the same was so made as aforesaid. Affiants further state that said testator was on the day of the said date of said will of then full age of twenty one years & upwards. Sworn to and subscribed this the 19th day of November 1869.
