In the matter of the estate of Robert G JOHNSON late of this county of Blount and the state of Alabama, deceased personally appeared in open court Henry JOHNSON son of said deceased and makes application to this court to grant unto him Letters of Administration on the goods and chattels rights and credits of the said Robert G JOHNSON deceased and it appears to the satisfaction of this court by proof duly made that the said died intestate and that the right of granting administration on his estate doth pertain to this court & is further appearing to the satisfatction of this court that _________ (left open) JOHNSON widow of said ddeceased waves her right of administration of the estate of said deceased. It is therefore ordered and decreed by hte court that Henry JOHNSON be and he is hereby appointed administrator of all and singular the goods and chattels rights and credits of Robert G JOHNSON deceased issue to the said Henry JOHNSON and that the same be filled and recorded. It is further ordered that the said Henry JOHNSON be and is hereby required to enter into bod in the penal sum of One Thousand Dollars conditioned for faithful performance of his duties as such administrator with good and sufficient securities. Whereupon the said Henry JOHNSON hath rendered in open court his bond as aforesaid with Reuben ELLIS and Austin MURPHREE as securities for the sum of One Thousand Dollars aforesaid and which is hereby approved and ordered to be recorded. ------------------------------------------------- Letter of Administration The State of Alabama Blount County I, John C Gillespie, Judge of the Probate Court of said county hereby certify that administration on the estate of Robert G JOHNSON were on the 30th day of September 1852 granted to Henry JOHNSON who has duly qualified and given bond as such and is authorized to administer such estate this the 11th day of October 1852. John C Gillespie Judge of the Probate Court for the County of Blount State of Alabama The petition of Henry JOHNSON administrator of Robert G JOHNSON late of the county & state aforesaid who died intestate repectfully showeth to your Honor that the personal estate of the said Robert G JOHNSON dec'd the intestate of your petitioner is not sufficient for the payment of his just debts of his said intestate and your petitioner further showeth to your honor that if the personal estate of his intestate was sufficient for the payment of his just debts of said intestate that the real estate could not be equally and beneficially divided without a sale of the said real estate of said intestate. Mary CHANEY daughter of dec'd of full age intermarried with James CHANEY said Mary is deceased & left children whose ages sex & residence are unknown supposed to be minors. Your petitioner parys that such proceedings be had on the promises as the law directs so that a sale of the before mentioned Lands may be had for the purposes aforesaid pursuant to the statue in such cases made to this 3rd Feb 1854. It is therefore ordered by the court here that the 2nd Monday in April next be appointed for the hearing of said petition. And that notice to the aforesaid who resides in the State of Alabama & that publication be made in a newspaper published in Guntersville Ala. For thrice consecutive weeks requiring the said now resident ehirs & the said resident heirs of said decedent to be and appear at the Court House in the Town of Blountsville at the time aforesaid and answer this petition. It is therefore ordered & decreed by the court here that Henry JOHNSON administrator of the estate of the said Robert G JOHNSON he and heirs hereby authorized to make sale of the one undivided half as the aforesaid described tract of land on a credit of twelve months at public auction on the premises after the first having given thirty days notice of time place and terms of sale and the purchase mony to secure by two good securities & make report of his proceedings under this order within sixty days after that date. -------------------------------------------- Report Sale To the Hon Judge of the Probate Court of Blount County Alabama The undersigned administrator of the estate of Robert G JOHNSON late of said county deceased respectfully represents to your Honorable court that he in pursuance to a decree proceed on the 25th day of May 1854 to sell to highest bidder on a twelve months credit on the premises after having given the notice required by the law the one individed (sic) one half of the following tract of land to wit: the East 1/2 of the NE 1/4 Section 32 the West 1/2 of the NW 1/4 of Section 33 all in Township 13 Range one East lying and being in the county aforesaid at which sale the Henry JOHNSON became purchaser thereof at the price and sum of nine hundred and fifty seven dollars he being the highest bidder there for this 17th of June 1854. On the premises sell at public outcry to the highest bidder the one undivided one half of the following described real estate (viz) the East 1/2 of the North East 1/4 of Section 32 & the West 1/2 of the North West 1/4 Section 33 all of Township 13 & Range one East situated in Blount County Ala. At which sale Henry JOHNSON admr as aforesaid became the purchaser at the price and sum of Nine Hundred & Fifty Seven Dollars he being the highest bidder therefore. And it appearing tot eh satisfaction of this court that the said sale was fairly conducted and the purchase money fully decreed. It is therefore ordered & decreed that the said sale be confirmed and that the said Henry JOHNSON administrator of the estate of the said Robert G JOHNSON deceased be and he is hereby authorized & required to convey to Henry JOHNSON his heirs & assigns all such right title & interest in and to the aforesaid real estate which the said Robert G JOHNSON held at the time of his death.
