Franklin (not associated with Tracking Your Roots) lisafranklin2004@earthlink.net and Belinda Jacks belindaj@sbcglobal.net October 30, 2008, 7:43 pm Source: Probate Minutes Volume 18 Page 85 Written: December 3, 1875 85 Order setting day to hear } Special Term Probate Court Petition to sell Lands } December 3rd? 1875 Twiggs Franklin administrator of said Estate having this day filed his application, in writing and under oath, praying for an order and proceedings to sell certain Real Estate in said petition described, of the property of said decedent at the time of his death, for division, and upon the ground that the same cannot be equitably divided among the heirs of said Estate, and it appearing from an inspect- tion of said petition, that the only heirs of said Estate are the fool- lowing named persons, to wit: Edmond Franklin, Twiggs Franklin, Catherine Burkett, wife of Evan Burkett, Mary Burkett widow of Henry Burkett, Rill Burkett, wife of Elias Burkett, Fernetta Burkett, wife of Bartilla Burkett, Adele Riley, wife of W C Riley all of whom are of full age, and Reside in the County of Butler & State of Alabama, and Hugh, Vine, Natty Ann, Moses and Frances Burkett, children of Kamiah Burkett, deceased, all of whom are minors except Hugh Burkett who is of full age and Resides in Butler County Alabama, The other four minors Resides in Monroe County, Alabama, & Stephen Franklin child of Morris Franklin decd, of full age and Resides in Monroe County Alabama; It is, therefore, ordered, that the 17th day of January 1876 be, and it is hereby appointed a day for hearing the said application, and the proofs which may be submitted in support of the same. It is further ordered, that due notice of the nature of said application, and of the time above set for the hearing there- of, be given at least forty days, before the said day of hearing, by publication in the Greenville Advocate, a newspaper publish- ed in said County of Butler & State of Alabama, for all persons in interest to appear and contest said application, if they think proper. It is further ordered that all of the above named heirs and distrib- uties of said Estate have notice of this proceeding, and the day set for hear- ing the same by citation be personally served on them, It is further order- ed that Ransom Seale Esqr be, and he is hereby appointed to act as Guardian Ad litum for and to protect the interest of Viney, Nelly Ann, Moses and Frances Burkett in the matter of said proceedings, and that The said Guardian Ad litum have notice of his said appointment.
