Alabama I Radford Ellis , of said County of Butler, State of Alabama, do make and publish this my Last Will and Testament, hereby revoking all former Wills, at any time heretofore made, First and first, I direct that my body be decently interred and as to such worldly Estate, as it hath pleased God to intrust to me, I depose of the same as follows: First: I direct that all my just debts and funeral expenses, be paid as soon after my decease as possible, and of the first money that shal come into the hands of my Executors, from any portion of my estate, and after such debts shall be paid I direct that the whole of my property both personal and real, shall be and remain the absolute property of my beloved wife Eliza, and I also direct that at the decease of my wife, the Estate so bequeathed to her shall be, and I further decree and order that my nephew Radford Ellis, after the death of my wife shall have all the property of my Estate, and I do hereby make and order my wife Eliza Ellis, Executrix of my last will and testament. In witness whereof I have hereunto set my hand and seal, and in the presence of this the 2d day of December in the year of our lord, one thousand eight hundred and sixty two. Attest { H. C. Bolling, Judge of Probate for said county The undersigned Executrix of the Estate of Radford Ellis, late of said county deceased, on the 19th of June last 1864, respectfully represents unto your Honor, that said decedent at his death left a paper writing purporting to be his last Will and Testament, which he herewith presents for probate. She further represents unto your Honor, that Eliza Ellis widow and relict of said Testator: The heirs and children of John and Peter Ellis deceased, who names are unknown to the Executrix, all residing in the state of Texas, some of whom, are minors as she is informed. Willis Ellis, Gallant Ellis, Hiram Ellis, Elizabeth Seagraves, wife of Tillman Seagraves, Theria A. Jones, wife of William Jones, all of whom are of full age and reside in the State of Georgia, they being the brothers and sisters of said Testator, They and they alone being the heirs and Legatees of said Estate. The premises considered she respectfull prays your Honor to make an order appointing a day for the Probate of said Will and make all orders or issues in the premises, that your Honor may deem meet and proper. This day came Eliza Ellis, Executrix of the Estate of Radford Ellis, deceased, who after being duly sworn on oath says that the facts set forth in the foregoing application to admit to Probate the Last Will and Testament of Radford Ellis decd. are true as herein stated.
