All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Wilda Murphy wildamurphy@gmail.com August 10, 2005, 2:57 pm Source: Butler County, Alabama, Will Book 1, Pg 143-144 Written: August 19, 1853 Will and Estate of James Seale Will Book 1, pg 143-144 The State of Alabama Butler County I James Seale of Butler County and State aforesaid do make and ordain publish and declare the following to be my last will and testament in manner and form following to wit: 1st All my Just Debts are to be paid by my executors. 2nd Will and desire that my Estate both real and personal in during (sic) what money in Specie and Bank Bills that may be on hand at the time of my death together with what debts may be due and owing to me at the time of my death may be equally and fairly divided among my following named children nine in number to wit: Mary Bates wife of Baalam Bates, Ransom Seale my Son, Matilda Palmer or Parmar wife of Ephraim Palmer or Parmar, Anderson Seale my Son, William Seale my Son Cyntha Ward wife of David Ward, James H Seale my Son, Thomas J Seale my Son and Clarinda Ham wife of William Ham, and be it now fully known and understood and I hereby expressly will direct and declare that such of my above named children as have received any advances from me heretofore and for which I have their receipt shall bring such advancements into hotchpotch and such sum so advanced to these shall be so accounted for as that no one of my said nine Children under this decree of my said will shall receive any more than another, and whereas the advances I held from my son James H Seale has (sic) been mislaid so that I cannot now find it that is to say to the amount of six Hundred Dollars over and above the receipt I now hold and have, I therefore will that he be charged with the amount of receipt I now hold and the additional sum of six Hundred Dollars which has been lost or mislaid and after such advancement are (sic) fairly and fully brought in and accounted for then such division be made as to render each child above named equal with each other, the same as if I had died intestate. 3rd It is my will and I do so hereby will and devise declare and direct that if any of the above named nine children should depart this life before I do, leaving issue alive then such issue so leaving at the time of my death shall take among them the share their father or mother would have taken had such father or mother survived me and it (sic) my further will and desire and I so will declare and direct that increase (sic) any of my said nine children above named shall depart this life before me leaving no issue alive then the portion to which such deceased children would have been entitled had they survived me shall be equally divided among my surviving children named in the second clause of this will. 4th It is my will and desire that none of the children of my deceased daughters Elizabeth Kelly and Elvira Cooper take any portion of my estate because I have made full advancements to my said Daughters in their lifetimes. 5th I hereby nominate constitute and appoint my Sons Ranson (sic) Seale and Anderson Seale Executors to this my last will and testament hereby revoking and setting aside all other wills by me heretofore made and declare this to be my only and last will and testament. In testimony whereof I have hereunto set my hand and affixed my Seal this nineteenth day of August in the A. D. 1853. James Seale Pg 145: Signed sealed and delivered and declared by the testator as his last will and testament in our presence who in the presence of the testator and in the presents (sic) of each other have subscribed our names as which thereto. Thos. W. Williams Wilson Murphy Alfred Carter The State of Alabama, Butler County. In the Probate Court of said County, Regular Term. March 12th 1860. In the matter of the Probate of the last will and testament of James Seale deceased Before me S J Bolling Judge of said Court personally appeared in open court Wilson Murphey and Alfred Carter who having been by me first respectively duly sworn and examined did and do depose and say on oath that they are each subscribing witnesses to the instrument of writing now shown to them and which perports (sic) to be the last will and testament of James Seale deceased lately an inhabitant of this county that said James Seale Senr. deceased signed and executed said instrument on the day the same bears date and declared the same to be his last will and testament and that affiants set their signatures thereto on the day the same bears date as subscribing witnesses to the same together with Thomas Williams the other subscribing witness in the presence of said testator and in the presence of each other that said testator was of sound mind and desposing (sic) memory and in the opinion of deponents fully capable of making his will at the time the same was so made as aforesaid. Affiants further state that said testator was on the day of the said date of said will over the age of twent one years. Sworn to and subscribed before me this the 12th day of March 1860. S. J.
