Mellon, of Oxford, Alabama, being sound mind and disposing memory, do hereby made and declare this to be my last will and testament, revoking any and all wills heretofore made by me. (1) I direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently can be done. (2) I have seven childrens, namely: W. Foster Mellon, R. Edward Mellon, Mrs. Neva Brittain, Sam A. Mellon, Miss Bettie Mellon, Thomas J. Mellon, and Mrs. Nellie Gray Aderholdt. I want to treat all my children alike. I want each of them to enjoy the same benefits in such property as I have. I have already advances to W. Foster Mellon from my estate the sum of one thousand dollars. I let him have this with the understanding that it be deducted from his part of such estate as I leave at my death as follows: In order to equalize I direct that said estate be divided so as to all of an equal share to each child, except W. Foster Mellon, who's share shall, because of this advancement, be one thousand dollars less than that to each of the others. (3) I do not think it advisable to rush a sale of the real estate. To do so would likely cause it to go at a sacrifice, I, therefore, direct that my executor hold, manage and control it for a period of two years, unless all the children, or representatives of children, join in a request for the sale to be made at an earlier date. In the event of such request, for sale of part of all, such part or parts or all my be sold at such time as all desire the sale to be made. (4) I direct that where practical, my executor divided the property without a sale. (5) I nominate and appoint Sam A. Mellon as executor of this last will and testament and direct that he be exempted from giving an official bond. In witness where of I hereunto set my hand on this the 18th day of December 1929. W.E.
