Wilkins, six hundred (dollars)and that she choose a guardian at the (age) of fourteen who shall take charge of said amount and when she marries or arrives at the age of twenty one (the) said money is to be given her for (her) use during her life and after her (death) to be equally divided between (her) children. 7th I give and bequeath to my daughter Cora C Wilkins six hundred dollars and when she arrives at the age of (next page of document) fourteen she shall choose a gu(ard-)ian who will take charge of (said) money and deliver to her (when) she marries or arrives at the age of twenty one for her use durin(g) her life and after her d(eath) to be equally distributed betw(een) her children. Witness further admited on cross examination that he was not present at the settlement which he has testified, between his wife (Am-erica M., that said settlem(ent) was made before his marriage (to) her which did not take place til 14 December 1873, and that (all) he knew about said settle(ment) was from what his wife had told him, and the admissions to him of Daniel J. Smith, Elizabeth Wilkins & William J. Smith. The defen(d)ants, objected, to all said witness had said about said settlement as being heresay testimony, but said objection was overruled the testimony admitted & defen(d-) ants excepted, Witness further stated th(at) (Page 13 of the Document) settlement spoken of by him w(as) a private one, That said Dan(iel)J. Smith was made no final (settle-)ment as such guardian in (the) probate court, nor has he been discharged by said court from his said guardianship. This being the day this case was adjourned to by the consent of the respective parties and their counsel to this suit, the 29th December last having been the day appointed by an order of the Judge of this Court make and entered, in this estate, on the 11th day of December 1874 for hearing the application of the said John C. Pierson and his wife America M. Pierson, the latter being the legatee named in said will of said deceased, asking for an order and decree of the Court, that her legacy be paid to her husband and herself for her use. Now comes the said John C. Pierson and America M. Pierson, and their counsel, and move the Court to proceed with such hearing. And it being shown that the proper notice and citations have been given to Elizabeth Wilkins administratrix and William J. Smith administrator de bonis non with the will annexed of said testator, in all respects strictly according to the terms and requirements of said former order in the premises, the Court proceeds to hear and determined the matter of said application: Whereupon, it being shown to the satisfaction of the Court, by due proof, that letters testamentary or of administration with the will annexed, were granted and issued by this Court to said personal representatives more than Eighteen months since: that by the terms of said will, the said America was bequeathed a legacy of six hundred Dollars, and the said will required the said America to choose a guardian when she arrived at the age of fourteen years, to whom the Executors of said will were to pay over said legacy. And the said America having chosen one Daniel J. Smith as her guardian to whom letters of guardianship were issued by this court on the 28 day of February 1866 and it appearing that said Executors have paid over to said Smith, as guardian on said legacy the sum of two hundred and twenty two Dollars - And it further appearing to the Court that since the said America has arrived at the age of twenty-one years, she has made a full settlement of the said guardianship with the said smith and released him from all liability as to the same. And it further appearing to the satisfaction of the Court that said personal representatives have assented to the payment of said legacys and that the same is due. And it further appearing to the Court that after the payment of the balance of said legacy, there will remain a sufficiency of assets to pay all the debts which have been presented, charges and other legacies entitled to priority, and that the remainder due upon said legacy with the interest thereon is one thousand and seventy two dollars up to the date of this decree.
