F. Bailey, being of sound and disposing memory do make and constitute and declare this to be my last will and testament, revoking any and all former wills made by me; 1. It is my will that my just debts be paid as soon as practicable after my death. 2. All the balance of my estate, I do will, bequeath and devise to my beloved wife, L. J. Bailey, during her natural life and after her death, I will and dispose of the balance of my property remaining as follows; 3. I will, devise and bequeath to my son, J. F. Bailey, my home house and five acres of land the house now stands on, said five acres to be measured and laid off by my son, J. F. Bailey. 4. It is my desire and will that all the remainder of my property be sold and equally divided among all my children, or incase of their death, their descendants, equally share and share alike and my son, J. F. Bailey, is to share equally with the others in this distribution. I hereby authorize and empower my executor hereinafter named to sell said property, either at public or private sale as he deems most beneficial to the estate and the heirs of estate and make said distribution among said heirs without obtaining any order from any court or of making any report of his conduct of my estate to any court of the land. 5. I hereby nominate and appoint my said son, J. F. Bailey, executor of this my last will and testament with the above named full and complete powers and relieve him, as such, from making any inventory of my estate or of making any report to any court of his conduct as such executor of my estate and also relieve him of making any bond or giving surety as executor of this my last will and testament. Grady, Judge of Probate in and for the County and State aforesaid, hereby certify that the within instrument has this day, in said court, and before me as the Judge thereof, been duly proven by proper testimony to be the genuine last will and testament of C. F. Bailey and that said will together with the proof thereof has been recorded in Will Record #6 and on Page 438. Given under my hand this the 3rd day of November, 1941. J. C. Grady, Judge of Probate Before me, J. C. Grady, Judge of Probate, in and for said County, personally appeared in open Court C. S. Moon, who, having been by me first duly sworn and examined, did depose and say on oath, that he is a subscribing witness to the instrument of writing now shown to him and which purports to be the last will and testament of C. F. Bailey, deceased, late an inhabitant of this County, that said C. F. Bailey signed and executed said instrument on the day the same bears date, and declared the same to be his last will and testament, and that affiant set his signature thereto on the day the same bears date as a subscribing witness to the same in the presence of said C. F. Bailey and B. A. Hodge and that such other witness subscribed his name as a witness in his presence and in the presence of said C. F. Bailey. That said C. F. Bailey was of sound mind and disposing memory, and in the opinion of deponent fully capable of making his will at the time the same was so made as aforesaid. Affiant further states that C. F.
