Both are buried in Frederick and Davis Cem (located West half of Section 8 Township 21, Range 28, Chambers Co, just off Huguley to Cusseta road. Book of Wills Nr. 3, pages 471 & 72. 4 Dec 1878. Will, dtd 25th of Oct 1878, Chambers Co, AL. "In the name of God, Amen: I, Thomas F. Davis, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do, therefore, make, ordain, publish and declare this to be may last will and Testament that is to say, first after my funeral expenses and all other of my lawful debts are paid and discharged, the residue of my Estate, real and personal, I devise and bequeath as follows, to-wit: 1st I give and bequeath to my beloved wife Matilda H. Davis, the settlement of land on which I now reside known as the Jackson land, lying between the two creeks in said county and state, supposed to contain five hundred acres more or less. Also the East half of Section eight (8), Township (21) twentyone Range (28) twenty-eight known as the Todd place containing three hundred and twenty acres more or less in same county & state, also two choice mules, one good two horse wagon and such household and kitchen furniture as she may select or want. Also such cattle, sheep and hogs as she may select from my stock then on hand with all the improvements on the above described lands. The foregoing property is given to my beloved wife during her life time in lieu of dower and at her death the same is to be divided among my children their heirs as directed below as to my other property. 2nd. I give and bequeath to the children of my deceased daughter Sarah L Rutledge an equal share or the share of my Estate that she would hav been be entitled to had she been in life and request Kinchen L. Haralson and Thomas J. Davis act as their Trustees. 3rd. I give and bequeath to the children of my beloved son, Jeter B. Davis, an equal distributive share of my Estate and request that he, Jeter B. Davis act as their Trustee. 4th. I also give and bequeath to my son Thomas J. Davis, my daughter Mary R. Haralson and my daughter, Nancy Willis an equal distributive share of my Estate. 5th. I hereby constitute and appoint my son-in-law Kinchen L. Harrelson & my son Thomas J. Davis Executors and my beloved wife Matilda H. Davis Executrix of this my last will and Testament with the request that they will execute the same according to the ??intentions thereof hereby revolking all former wills mady by me. 6th.
