Robinson Judge of Probate Recorded in B. of Wills No. 3 on page 564 THE STATE OF ALABAMA ) CHAMBERS COUNTY ) In the name of God Amen. Know all men by these presents that I, HUGH WILSON of the County of Chambers and State of Alabama being of a sound and disposing mind and memory and knowing the uncertainly of this life and the certainty of death and being unable from old age to look after my farming interest and to free my lands from Mortgages or other liens that are now upon them I this day haveTurned over into the possession of WALTER S. TUCKER my entire estate both real and personal EXCEPT my household goods upon condition that said WALTER S. TUCKER shall pay oft or settle all of my indebtedness of every description and give to me and my wife MARTHA A. WILSON or furnish us with all the necessary food, raiment and attention both personal and medical that may be necessary for us to have a comfortable support and also upon condition that the said WALTER S. TUCKER shall pay off or furnish each of my daughters, to-wit: CUE WILSON and MARY WILSON with the necessary bed, board, and clothing and attention both personal and medical that may be necessary to render each of them comfortable as long as they may remain unmarried either before or after my death so long as they remain as members of the said WALTER S. TUCKER family and for and in consideration of the attention - in and support faithfully and properly rendered by the said WALTER S. TUCKER I the said HUGH WILSON hereby make, publish and declare this to be my last will and testament hereby revoking all former wills that I may have made. FIRST, I will and desire that at my death my body shall be buried in a decent and Christian like manner. SECOND, I will and desire that if my wife MARTHA A. WILSON shall survive me that after she is dead her body shall be also buried in a decent and Christian like manner. THIRD, I will and desire that after my death and burial that all of my just and lawful debts be paid. FORTH, I will and bequeath to said WALTER S. TUCKER my entire estate both real and personal said real estate described as follows; To-wit: One hundred and fifteen acres more or less of the south half of section 20, Township 21, Range 26 Bound on the North by C. J. Sturkie or the East by Tobias Falwood south by W.S. Tucker and West by Opelika & Dudleyville Road, To have and to hold to said WALTER S. TUCKER his heirs and assigns forever. In testimony whereof I have to this my last will and testament contained on this sheet of paper subscribed my name and set by Seal this the 23 day of January in the year of our Lord One Thousand Eight hundred and Eighty five (1885). /s/ HUGH WILSON (L.S.) ROBINSON Judge Probate Court Chambers County: The petition of the undersigned WALTER S. TUCKER respectfully represents unto your Honor that HUGH WILSON who was at the time of HIS death an inhabitant of this County, departed this life at HIS HOME on or about the 13 day of AUGUST 1887 leaving assets in this State, and leaving a Last Will and Testament duly signed and published by HIM and attested by C. J. STURKIE & B. M. CONWAY. That your petitioner, as HE verily believes, is named in said will as DEVISEE and does now herewith surrender said will to the Court, and pray that after proper proceedings and proofs, it may be probated and admitted to record as the true last will and testament of said deceased. Your petitioner further represents that MARTHA WILSON Now DECD was the widow of said deceased, and that the names, ages, residence and condition of the next of kin are as follows, to-wit: CATHERINE TUCKER, WIFE of W. S. TUCKER, CUE WILSON, MARY WILSON, & J. W. WILSON, ALL OVER TWENTY ONE YEARS OF AGE AND RESIDE IN CHAMBERS COUNTY ALA. Your petitioner would further represent that the said attesting witnesses C.J. STURKIE & B. M. CONWAY RESIDE IN CHAMBERS COUNTY ALA and therefore further prays that your Honor will SET A DAY FOR HEARING OF SAID PETITION AND MAKE SUCH FURTHER ORDERS AS OR LAW REQUIRED. /s/ J. R.
