D. being of sound mind and disposing memory do hereby make and publish this my last Will and testament hereby revoking any former Will by me at any time heretofore made. First- It is my will that all my jsut debts, including my funeral expenses and the cost of a suitable monument to be erected at my grave shall be paid by my executors hereinafter named as soom after my death as may be convenient. Second- I give and devise and bequeath to my beloved wife- FANNIE for and during her natural lefe or widowhood my residence and grounds at SPRING GARDEN, AL and all my household and kitchen furniture therein or used in connection therewith, also my FARM located at SPRING GARDEN, containing about ninety (90) acres and the FARM located on HURRICANE CREEK, known as the BURNS or WEEMS place and my undivided three fourths interest (the other one-fourth interest belonging to her in fee simple in the FRANK MITCHELL homestead, located at Spring Garden) also my horse and buggy. I have heretofore given to her my office building in Spring Garden the title thereto being in her name. In case of the remarriage of my said wife, her interest in all of the property above enumerated, give to her by this will, shalll cease and terminate except that she shall take and have in fee simple the suit of furniture, beds and bed linen in the room of my residence used by me. Third- I give and bequeath to my Youngest Son- TAUL B. WHITE, the Gold Watch used and worn by me. Fourth- I hereby authorize enpower and direct my executors hereinafter named as soon after my death as the may be proper to sell and convey either at public or private sale, the FARM- formerly belonging to my MOTHER and known as the WHITE Farm located on FROG Creek in Cherokee County, AL of the proceeds of said Farm, I give and bequeath to my Daughters, ANNA GARNETT, the Wife of George GARNETT, and MARY ALLGOOD, the Wife of Dr. J. P. ALLGOOD, and My Son- Taul B White, the sum of four hundred ($400.00) dollars each for the purpose of equalizing their shares of my estate with my other children. I having heretofore advanced from time to time certain moneys to my said children amoun ting to about the sum of four hundred ($400.00) dollars and the balance of the proceeds of said farm shall be divided equally between my said wife FANNIE and all my children or the descendants of such of my said children as may be (?) namely, WILLIAM T. WHITE, JOHN G. WHITE, HUGH H. WHITE, JAMES N. WHITE, TAUL B. WHITE, ANNA GARNETT, MATTIE WHORTON, and MARY ALLGOOD. The distributive share of my estate which is willed to my Daughters, Anna Garnett and Mattie Whorton shall be held by my executors in trust as hereinafter provided my daid Daughter Anna annually so long as she may live and upon her death, leaving a child or children her part of my estate shall be paid over to her said child or children in equal parts and if she should leave no child surviving her, that part of my estate willed to her shall be equally distributed by my said executors among my remaining children share and share alike and the descendants of such as may be (?). Fifth- I hereby appoint my sons -William T. WHIRE and Hugh H. White executors of this my last Will and Testament and having full faith and confidence in their integrity and capacity I direct that they shall not be required to execute bond.
