STATE OF ALABAMA, Clay County 
Probate Court, Register Term
Feb'y. 8th 1869. 
THIS day came John W. Barton, administrator of the estate of John B. Overton, 
late of said County deceased, and filed his application in writing, under oath, 
for an order of sale of all the real estate belonging to said decedent at his 
death in said County, alleging that it is necessary to sell the same for that 
purpose of making an equitable division of the same among the heirs of said 
estate, And stating therein the names and residence of said heirs, and it 
appearing from petition that Sarah 0. Overton, late relict and widow of said 
decedent, Horace Overton, and three Minor Children, to wit: Joseph, Artelia and 
John B. Overton, who are heirs said decedent, are nonresidents and reside in the 
State of Georgia Fulton County also, Adolphus Overton, residence unknown. It is 
therefore ordered by the Court that Saturday the 27th day of March, 1869, be set 
as a day for hearing said application before this Court, at Ashland, Ala., and 
that notice of the tune and place of hearing the same be published in the 
Alabama Reporter a newspaper published in the town and County of Talladega, in 
said State, for forty days before the day set for hearing that conies of said 
published notice he forwarded by mail, postage paid, to each of said nonresident 
heirs within five days after the first publication shall, have appeared.
