Williams, Judge of Court of Probate the same being a court of Record within and for said county and state aforesaid, Mary Mitchell aged 51 years and EMELY GRAVETTE, aged 45, both children of John Mitchell by his first wife, and who are well known to me, and whom I certify to be in every way worth and entitied to credit and who being duly sworn according to law depose and say that they were acquainted with John Mitchell's second wife, who was Edie(?) Hurst before her marriage with their father. That the said Edie Mitchell nee Hurst died on or about I2 day of March 1847, that they were present and saw the corpse of Edie Mitchell and recognized it as the body of their said step-mother. That they were present and saw her body buried. That John Mitchell's first wife was their mother, that she died on or about 2 day of July 1840. That they were present and saw her remains after she was dead and that they knew that it was the body of their mother, Emily Mitchell, first wife of John Mitchell and that they have no interest in the prosecution of this claim either direct or indirect. /S/ /S/ Mary Mitchell Emily Gravett THE STATE OF ALABAMA CLAY COUNTY On the 15 day of March 1879, personally appeared before me James L. Williams, Judge of County of Probate The same being a counrt of record within and for said county and stae aforesaid. Catherine S. Mitchell aged 71 years a resident of Clay County, Alabama who being duly sworn according to law deposition says that she is a widow of John Mitchell deceased who was the identical John Mitchell who applied for and obtained pension certificate No 20636 for service redered in War of 1812. Claimant further states that she was married to the said soldier, John Mitchell in Talladega County, Alabama on 7 day of April 1852 by one Charles W Roby a Justice of the Peace that has name before her said marriage to soldier John Mitchell was Catherine S. Fox. That her said husband, John Mitchell, died on or about the 17th day of May 1871 at his residence in Clay County Alabama and that she has not remarried since the death of the soldier. That the said John Mitchell was married twice before her said marriage to him. That his first wife's name before his marriage to her was Emily Holtzclaw. That she died on or about the ....day of....1840 . That his second wife's name was Edie Hurst. That she died in Randolph County, Alabama on or about .... day of... 18..., and she states that the following her? depose and say that the have known Catherine S. Mitchell for 18 and 20 years respectively. That they were present and saw her make her mark to the foregoing declaration. That they have every reason to believe from this appearance of said claimant that she is the identical person she represents herself to be, that they are able from their personal knowledge of her that she is the person who was the wife of John Mitchell deceased who obtained persion certificates as above stated in declaration of claimant And they further state that have no inerest either direct or indirect in the pronsecution of this claim.
