The jury fixed the punishment at ten years in the penitentiary. The difficulty which resulted in the death of Latham occurred near Delta last winter. After being shot the deceased lingered between life and death for, seventy-five days after his spine had been severed by the missile which finally proved fatal. The defendant set up a plea of self- defense. When the case of the State vs W. Joe Smith was called in court last Saturday morning, the defendant failed to appear in court and a forfeiture was taken against him and his bondsmen. The defendant had been seen at court and in this community until two or three days prior to the day his case was called for trial. About three years ago the defendant shot and killed W. J. Lumpkin, his father-in-law, in a dispute over a dog. The defendant had been tried at a prior term of court and was convicted of manslaughter in the first degree and his sentence fixed at five years in the penitentiary, but his case was reversed by the Supreme Court.
