L. Kirk, received a slight wound and narrowly escaped more serious consequences. Considerable excitement followed. There were four negro prisoners in jail at the time and Mr. Kirk, who sleeps in the jail, had left his pistol in his apartments. It seems from the reports that one of the prisoners, called Jim Weaver, had through the assistance of a smaller negro, managed to get hold of said pistol and when Mr. Kirk went in to retire for the night, fired on him, striking him in the lower, soft part of the ear. Sheriff Hamlin and City Marshal Mayo soon arrived on-the scene and got the pistol from the negro and averted further trouble. In the meantime, a large crowd assembled about the jail and considerable excitement prevailed till a late hour of the night. Because of the high feeling which existed the negro was removed to Talladega the following day.
