Judge Pearce of that circuit, refused to take any testimony in the case and they petitioned the supreme court for mandamus to compel the Judge to take testimony. Feb 26, 1909, Lineville Headlight: The jury was completed in the case of the State vs Barney Worthy by noon last Friday. The State made out its case and rest ed Saturday morning when the defendant began to present his side of the case. The evidence was all in. by 5 o'clock Saturday afternoon, but the court announced that arguments would be made and the jury. charged Monday morning. The case went to the jury Monday at noon and the jury brought in a verdict of guilty of manslaughter in the first degree and fixing the punishment of the defendant at a year and a day in the penitentiary. Before sentence was pronounced by the court, defendant made a ten minutes talk. Jul 1, 1909, Mongomery Advertiser: Whether Barney Worthy hollered 'shoot." or "don't shoot," was a consideration upon which his freedom rested. For Worthy, a white man. had been sentenced to one year and a day during the spring term of the Clay County Court, for manslaughter. The specific charge was that he stood by and encouraged the murderer. Evidence showed that he cried "shoot." He was convicted. Other testimony was to the effect that he said, "don't shoot" There was ground for an application for pardon. Worthy was pardoned by Governor Comer especially when it was shown that he had lain in prison for two years, awaiting a trial, while the State had continued the case from time to time.
