Smith of this county, who was serving a three-year sentence for assault with intent to murder. Later reports confirmed the telegram and stated that the deceased was struck by a stray bullet fired by the dog warden who was shooting at a hawk. Mr. Smith, although a consider able distance away, is said to have been shot through the brain and killed almost instantly. Mr. Smith's people were notified of the tragic occurrence and his remains were brought to his old home near Delta for interment. Additional Comments: Lineville Headlight Aug 30, 1912: On Monday, the case of the State vs Jay van Smith, of Delta, who was charged with assault with intent to murder, went to trial. There were more than 150 witnesses in the case. He and his son, Bud Smith, were charged with shooting info a wagon load of people on their way to church in the Fishhead community this Spring. Three people were wounded. The juries convicted both Jay van Smith and his son, Bud Smith, on charges of assault with intent murder.
