F. Darby Complaintant vs. Mary (Porter) Darby Defendant This cause coming to be heard on this April 23, 1912 was submitted for decree upon Bill of Complaint, Decree Pro Confesso on personal service and on cross- bill and testimony as noted by the Register; and, on consideration thereof, the Court is of the opinion that the Complaintant is entitled to the relief prayed for in his said Bill, so far as the question of divorce is concerned - and that the respondent is entitled to the relief prayed for in her answer and cross-bill relative to the care, custody, control and maintenance of the child - the son of the complaintant and respondent. It is therefore ordered, adjudged and decreed by the Court that the bonds of matrimony heretofore existing between the complaintant and defendant be and the same are hereby dissolved and the said P. F. Darby is forever divorced from the said Mary Darby for and on account of voluntary abandonment; and it is further ordered and decreed that the respondent Mary Darby have the care, custody, control and maintenance of the child herein above named. It is further ordered that the said P. F. Darby and Mary Darby be, and they are permitted to marry again upon payment of the costs of this suit. It is further ordered, that neither party shall again marry except to each other, until sixty days after decree is rendered, and that if an appeal is taken within sixty days, neither party shall again marry except to each other, during the pendancy of said appeal. It is further ordered that the said P. F. Darby pay the costs herein taxed, for which execution may issue, and if such execution be returned "no property found," then the execution for such costs may issue against _________ This 23 day of April 1912 E.
