CLEBURNE COUNTY, ALABAMA PROBATE and WILL RECORDS 1867 - 1884 Vol. 1

Report of rental lands income in the Estate of Nelson Higginbotham, deceased
State of Alabama, Cleburne County Probate Court
January 28, 1874

To the honorable William R. Hunnicutt, Judge of Probate of said county:  the 
undersigned Executor of the Last Will and Testament of Nelson Higginbotham, 
dec'd, reports that in pursuance of an order heretofore made by said court 
authorizing and empowering said Executor to rent the real estate of Nelson 
Higginbotham, deceased,  did rent said real estate on March 11th A.D. 1873 to 
Executor the home place and Mill at $155., the other side of the creek to J. 
Mencrief   for $155. wit W.F. Bacchus and William Noel securities; the Taylor 
Higginbotham place to J.R. Tenison for $125. with C. Haywood as security; the 
house place on this side of the creek to Rhoda Wheat at $205.00 with James 
Rusk as security; the other side of the creek was rented in 1871 to John 
Gamble and Joseph Gamble for part of the crop $99.20. Taylor place rented to 
P.Kelly in 1871 for one bale of cotton weighing 500 lbs at 14 cents per pound  
$70.,  to rent at Mill $39.24.  Th rent wheat on farm $22.50, rent corn at the 
Mill twenty five bushels of corn $25.  Recapitulations:

Before me, F.M. Campbell, a justice of the peace in and for said county of 
Cleburne, State of Alabama, the undersigned executor who being duly sworn says 
that the foregoing report is correct to the best of his knowledge. Sworn to 
and subscribed before me this 28th day of January 1874.  Burrel Higginbotham,

State of Alabama, Cleburne County
January 28th, 1874
To the honorable William R. Hunnicutt, Judge of probate court in and for said 
county:  the undersigned executor of the will of Nelson Higginbotham, 
deceased, reports that in pursuance of an order heretofore made by the court 
authorizing and empowering the undersigned to sell the realy belonging to the 
estate of said decedent, after having given due and legal notice by 
advertising the same at the court house and three other public places for 
three weeks previous to the day of sale, setting forth the time, terms and 
place of sale on Monday the 26th of January 1874, at the place appointed for 
said sale and between the legal hours of sale did offer said realty for sale 
at public outcry and at said sale Burrel HIgginbotham having an interest in 
said land and executor being the highest and best bidder and last bidder 
became the purchaser of E 1/2 of the NE 1/4, E 1/2 of the SW 1/4, SW 1/2 of 
the SW 1/4 S 1/2 of the NE 1/4 of section 18 E of the NW and Section 11 
Township 17 and Range 9 at thirty six hundred dollars, $3600.  The said 
Executor reports that said sale was fairly conducted and that said realty was 
sold for an amount not disporportionate to its value wherefore the said 
executor prays that said sale be confirmed and ratified and that an order be 
granted apponting a speical administrator to execute titles to Burrel 
Higginbotham for the said real estate purchased by him when the payment of the 
purchase money all of which is respectfully submitted.  Burrel Higginbotham, 
Executor.  Sworn to and subscribed before me this 29th day of January 1874.
