Ala State of Alabama, Randolph County November 7th, 1865 To the honorable probate court of said county: the undersigned administrator of the estate of Wm. F. Kennedy of said county, deceased, respectfully represents unto your honor that said decedent died seized and possessed of a certain tract of land known as the east half of the northeast half of section 31, township 17, range 9 on which there is thirty acres of cleared land in a state of cultivation ; he alleges that to rent said land is necessary for the interest of said estate on a credit of twelve months for standing rent subject to deductions for repairs of said fence. He therefore petitions your honor to grant an order authorizing and empowering him to rent the same as may seem meet and proper and your honor at such time and place and on such terms as may please your honor; all of which is respectfully submitted. State of Alabama, Randolph County December 9th 1865 To the honorable probate court of said county; the undersigned administrator of the estate of Wm. F. Kennedy, deceased, respectfully represents unto your honor that by virtue of an order made by the probate court of said county, he after giving the notice required by law in such cases, rented the lands of said decedent to the highest bidder at public outcry and on a credit of twelve months. A.C. Humphries being the highest and best bidder, therefore became the renter and executed a note for one hundred and twenty five dollars, that being the highest amount bid; the note is made payable twelve months after date and dated November 17th 1865 with A. Leveritt and U.E Humphries securities. All of which is respectfully submitted which asks your honor to receive, record and file. Burrel Higginbotham, Administrator. Sworn to and subscribed before me this 9th day of December 1865. R.S. Heflin, Judge of Probate State of Alabama, Randolph County February 26th 1867 To the honorable R.S. Heflin, Judge of probate for said county: the undersigned administrator of the estate of W.F. Kennedy, deceased, respectfully reports unto your honor that by virtue of an order made by the probate court of said county, he after giving notice for three successive weeks of time and place of rent by posting up advertisements one at the court house and three other public places in said county, rented at the residence of the said decedent all the lands belonging to said estate at public outcry to John H. Bowman for $125. he being the highest and best bidder therefor, who executed note for $125. with Gideon Riddle and W.M.Logon security payable __ 7th 1867, all of which is respectfully submitted. Kennedy, dec'd: Lovedvan a minor daughter of decedent who resides in Calhoun County, Ala Lafayette, and Ghent, and Rhoda and Julia, minor children of decedent who reside in Cleburne County, Ala. Kennedy, dec'd, who being duly sworn says that the foregoing named persons and they alone are the heirs at law and distributees of said decedent. Sworn to and subscribed before me this December 9th 1867. C.C. Enloe, J.P. Burrel Higginbotham. State of Alabama, Cleburne County Probate Court Minutes 1867 - 1870 page 215 Request for Estate of W.F. Kennedy to be transferred from Randolph County, Alabama to Cleburne County, Alabama, this March 2nd, 1870 State of Alabama, Randolph County To the honorable judge of probate of said county: The undersigned Administrator de bonis non of the estate of Wm. F. Kennedy deceased, respectfully represents unto your honor that he is the administrator de bonis non of the estate of W.F. Kennedy, deceased as above stated and as the administrator as above, resides in the County of Cleburne and that all but one of the heirs and legatess of said decedent resides in the said county of Cleburne, Ala except one who resides in Calhoun County, Ala., and further that the corpus of said estate is in Cleburne County, also said administrator therefore petitions your honor to grant an order transferring said administration to the said county of Cleburne. He further represents unto your honor that said estate will not in any way be harmed and the interest of said estate will not be injured by a transfer to said county of Cleburne; your petitioner therefore prays. This 2nd day of March 1870. Burrel Higginbotham Probate Court Special Term 1870 March the 2nd, 1870 This day came Burrell Higginbotham, administrator de bonis non of the estate of William F. Kennedy, deceased and made application for a transfer of the said administration to the county of Cleburne and it being made to appear to the satisfaction of said Judge that the interest of said estate will not be injured by a transfer to said county of Cleburne, it is therefore ordered by the court that said application be granted and that said administration of the estate of William F.Kennedy as aforesaid be transferred to Cleburne County and that all the original papers and a copy of all the orders of this court in said administration be forwarded to the Judge of Probate of Cleburne County. W.W. Dobson, Judge of Probate, Randolph Co. Ala. State of Alabama, Randolph County March 2nd 1870 I, W.W. Dobson, Judge of Probate in and for said county, certify that foregoing transcript is correct as it stands on record up to this date. I also send the papers and bonds on file wherein Burrel Higginbotham, is Administrator of the Estate of W.F. Kennedy, deceased; this 2nd day of March 1870. W.W. Dobson, Judge of Probate Cleburne County, Alabama Probate Court April 2, 1870 Burrell Higginbotham, Administrator De Bonis Non of the estate of Wm. F. Kennedy, deceased, reports to me that the lands of said estate were rented for the year 1868 to William Daniel for $125.; note taken to secure payment for rent with W.C. Kennedy, G. Meaders and A. Leveritt as securties. Also that said lands were rented for the year 1869 to George Daniel for $125. with A. Leverritt and W.U. Striplin as securities on land for rent of 1869. Also that said notes were made payable to Nelson Higginbotham, Guardian of said Distributees. April 2, 1870. W.R. Hunnicutt, Judge of Probate Amount of Rents on the lands of Wm. F. January 28th, 1874 To 1 note on W.M. Ligon, D.R. Ligon and D.G. Ligon for four hundred and fifty dollars due 1871 with interest from 1870. State of Alabama, Cleburne County Before me, F.M. Campbell, a justice of the peace in and for said county, appeared Burrel Higginbotham, Executor of Nelson Higgonbotham deceased, who after being duly sworn says that the foregoing is a full and complete inventory of Nelson Higgibotham deceased of the personal property of H.C.
