BARKER APPLIES FOR LETTERS OF ADMINISTRATION on ESTATE OF NANCY CHANDLER, deceased State of Alabama, Cleburne County July 17th, 1868 At this term of the court, J.C. Barker having made application for letters of administration on the estate of Nancy Chandler, late of said county, deceased, he having given bond and otherwise complied with the law. It is therefore ordered by the court that letters of administration issue to J.C. Barker upon the estate of Nancy Chandler, as aforesaid, this 17th day of July 1868. The following appraisers are appointed to appraise the estate to wit: F.W. Vaughan, Lemuel Edwards and ? Norton, and ordered to make a return according to law. A.D. Chandler, Judge of Probate State of Alabama, Cleburne County Probate Court Know all men by these presents that we, J.C. Barker and Wm. Henry are held and firmly bound unto A.D. Chandler, Judge of the Probate Court and his successors in office in the sum of nine hundred dollars for which payment will and truly to be made, we bind outselves, our heirs, executors and administrators firmly by these presents. Signed and sealed this 16th day of July 1868. The condition of the above obligation is such that the above bound J.C. Barker has this day been appointed administrator of the estate of Nancy Chandler, late of Cleburne County, Ala., deceased. Signed and sealed the day above written. J.C. Barker, Wm. Henry . Chandler, Judge of Probate ____ ORDER LICENSING ELIAS GRAY TO PEDDLE GOODS State of Alabama, Cleburne County July 25th 1868 This day appears, Elias Gray who makes application for a license to peddle for twelve months in this state, pottery, hats, shoes, tin ware and such other articles of home manufacture as are manufactured or grown in this state, he having made oath that he will peddle no other articles than those above specified and otherwise comply with the law in the premises. It is therefore ordered that a certificate of license issue to said Elias Gray as aforesaid this 25th day of July 1868. A.D. Chandler, Judge of Probate __________ PETITION OF NELSON HIGGINBOTHAM to be APPOINTED GUARDIAN OF MINOR HEIRS of WM. KENNEDA State of Alabama, Cleburne County Probate Court August 29th 1868 This day came Nelson Higginbotham and filed his petition in said court and prays to be appointed guardian of the minor heirs of William Kenneda, late of said county, deceased. The premise considered it is ordered that the said petitioner Nelson Higginbotham be appointed guardian of the minor heirs of William Kenneda, to wit: Fayet A. Kenneda, Rhoda A. Kenneda, Clay Gent Kenneda, Julia A.H. Kenneda, all under the age of twenty-one years. A.D. Chandler, Judge of Probate Guardian Bond State of Alabama, Cleburne County Know all men by these presents that we are held and firmly bound unto A.D. Chandler, Judge of the Probate Court, and his successors in office in the sum of fifteen hundred dollars for which payment will and truly to be made, we bind ourselves, our heirs, executors and administrators firmly by these presents. Signed and sealed the 29th day of August 1868. The condition of the above obligation is such that the above bound Nelson Higginbotham has this day been appointed guardian of the minor heirs of William Kenneda late of said county, deceased, to wit: Fayette A. Martin Approved this 29th day of August 1868. A.D. Chandler, Judge of Probate State of Alabama, Cleburne County Court of Probate Personally appeared before S.D. Wheat, a justice of the peace in and for said county, Nelson Higginbotham who after being duly sworn deposeth and saith that Lafayette Allen Kenneda, heir of Wm. Kenneda, deceased, is 14 years old and has chosen him the said Nelson Higginbotham to be his guardian. Sworn to and subscribed before me this day August 29th 1868. Nelson Higginbotham, S.D. Wheat, J.P. State of Alabama, Cleburne County Probate Court Whereas, on the 29th day of August 1868, Nelson Higginbotham was duly appointed guardian of Fayette A. Kenneda, Rhoda A. Kenneda, Clay Gent Kenneda, Julia A.H. Kenneda, under the age of twenty one years, and the said Nelson Higgonbotham having complied with the requisites of the law in such cases made and provided these are therefore to give said Nelson Higginbotham in whose fidelity in this behalf we very much confide full power and authority to demand and receive all and singular the estate, real and personal and all debts and demands whatever to said minors belonging and to do all other acts and things concerning said guardianship in as full and ample manner as if the same were herein particularly expressed. CRUMPTON, ORDER & DECREE FOR DOWER in the ESTATE of JEHU CRUMPTON, Deceased State of Alabama, Cleburne County Sept 12th, 1868 Personally came Mary F. Crumpton, widow of Jehu Crumpton, late of said county, deceased, and files her petition in writing in this court alleging that she is the widow of the said Jehu Crumpton, that she is entitled to her dower or one third part of certain tracts or parcels of land lying in Cleburne County, containing eight hundred acres more or less whereof the said Jehu Crumpton during their intermarriage was seized and possessed and it appearing to the satisfaction of the court that Mary F. Crumpton, the administratrix of the estate of the said Jehu Crumpton, deceased has been served with notice of the pendency of said petition. That Francis E. Crumpton over the age of twenty one years; Sarah A. McLeroy wife of William F. McLeroy over the age of twenty one years; James W. Crumpton, William V. Crumpton, Samuel R. Crumpton, Louis J. Crumpton, Thomas N. Crumpton, Wesley H. Crumpton under the age of twenty one years, the only children and heirs of the said Jehu Crumpton, deceased. Two oldest of full age and seven youngest under twenty one years of age and John McLeroy guardian adlitem of said minors has been notified in terms of the law that said petition would be filed and proceedings prayed thereon this day and publication according to law having been made notifying all parties interested in the pendency of said petition and the said Mary F. Crumpton, Executrix and John McLeroy guardian ad litem of the said minor children and heirs of the said Jehu Crumpton, deceased, having failed to appear and contest the prayer of said petition, and it appearing to the satisfaction of the court that the said Mary F. Crumpton is entitled to Dower in the above described lands. It is therefore ordered and decreed that one third part of the said lands as above described be set apart and decreed to be the dower of the said Mary F. Crumpton in the aforesaid lands of her said husband. It is further ordered that a writ of admeasurement of Dower issue to the Sheriff of said county commanding him to summon five discreet freeholders as commissioners who shall be connected to the parties neither by blood or marriage and are entirely disinterested who shall upon oath, allot and set off by metes and bounds to the said Mary F. Crumpton one third part of the before described premises having regard to the improvements and quality of the land as the quantity of the Dower and that the action of the said commissoners with the return of said Sheriff be made to this court on the first Monday in October next. A.D Chandler, Judge of Probate __________ JOHN C. BARKER PETITION TO SELL LANDS OF ESTATE OF NANCY CHANDLER, deceased State of Alabama, Cleburne County September 16th, 1868 This day came John C. Barker, administrator of the estate of Nancy Chandler, deceased and presented a petition in writing showing the the real estate of said deceased cannot be equiteably divided among the legal heirs of said decedent, therefore prays an order of said court to sell all the real and personal estate of the said decedent for the purpose of payment of debts and distribution. That decedent died seized and possessed of the following described lands to wit: Southest fourth of section six in township sixteen and range eleven east in the Coosa land district in Cleburne County, Alabama. Thereupon the premises being considered it is ordered by the court that Thursday 29th day off October next be set for the hearing of said petition and that notice thereof be made by publication in the Jacksonville Republican newspaper published in Calhoun County, for three successive weeks prior to said day as a notice to all persons concerned to be and appear at a special term of said court to be held at the courthouse in said county on the 29th day of October 1868 and defend against said petition of they think proper.
