The said Harriet Kennedy having complied with the law by filing bond in this office and it appearing to the satisfaction of the court that the said Harriet Kennedy is a suitable person to be so appointed such guardian, it is therefore ordered by the court that Harriet Kennedy be and she is hereby appointed guardian of the minor heirs of Hesakiah Kennedy, late of Cleburne County, deceased, to wit: James Walker Kennedy, Louisa Kennedy, Nancy Kennedy, over fourteen years old, and Hulda A. Kennedy, Anna Kennedy, Narcissa Kennedy, Emma Kennedy under the age of fourteen years. The three oldest of which have chosen Harriet Kennedy as their lawful guardian and it is further ordered that Letters of Guardianship issue to said Harriet Kennedy as such guardian of said minors as aforesaid. Issued this 20th day of November in the year of our lord, one thousand eight hundred and sixty eight. A.D. Chandler, Probate Judge, Cleburne Co., Ala. GUARDIANS's BOND State of Alabama, Cleburne County Know all men by these presents that we, Harriet Kennedy, Nelson Higginbotham, G.M. Miller and S.D. Wheat are held and firmly bound unto A.D. Chandler, Judge of Probate court and his successors in office in the sum of fourteen hundred dollars for which payment well and truly be made to bind ourselves our heirs and executors and administrators firmly by these presents, signed and sealed the 16th day of November 1868. The condition of the above obligation is such that the above bound Harriet Kennedy has this day been appointed guardian of the minor heirs of Hezakiah Kennedy, deceased, to wit: James Walker Kennedy, Louisa Kennedy, Nancy Kennedy, Hulda A. GRIMES for APPRENTICESHIP State of Alabama, Cleburne County Probate Court September 17, 1868 On this day came Wm. K. Grimes and made application to petition in writing to said court praying an order binding to petitioner, Wm. R. Grimes, a male minor to him the said Wm. K. Grimes, said minor having no estate or means of support or parents in this state. The court being satisfied that the allegation set forth in said petition are true. It is therefore ordered by the court that said minor be apprenticed to said petitioner in terms of the law, said Wm.K.Grimes having given bond and otherwise complied with the reqisites of the law. A.D Chandler, Judge of Probate ____________ W. R. HUNNICUTT APPOINTED GUARDIAN ADLITEM FOR MINOR HEIRS OF NANCY CHANDLER, Dec'd. State of Alabama, Cleburne County Probate Court September 16, 1868 J.C. Barker, Admr. of the estate of Nancy Chandler, deceased, having petitioned the court for an order to sell the land of said estate for the purpose of paying debts and for distribution, it is therefore ordered that W.R. Hunnicutt be and he is hereby appointed guardian adlitem of the minor heirs of said estate. A.D. Chandler, Judge of Probate __________ THOMAS BEAM AND JUDGE H. BEAM APPRENTICED TO ELIAS GRAY State of Alabama, Cleburne County September 23, 1868 Application having been made on this day and an order obtained binding Thomas J. Beam and Judge H. Beam to Elias Gray, the said Thomas J. Beam being of the age of 8 years and Judge H. Beam of the age of 6 years until said minors attain the age of 21 years. The court is satisfied the allegations in said petition are true, it is therefor ordered by the court that the aforesaid minors be apprenticed to the said Elias Gray in terms of the law. A.D. Chandler, Judge of Probate ___________ LOUISA ALEXANDER APPLIES FOR LETTERS TESTAMENTARY on LAST WILL & TESTAMENT OF JAMES E. ALEXANDER State of Alabama, Cleburne County Probate Court September 23, 1868 This day came Louisa Alexander who produced to the court a paper purporting to be the Last Will and Testament of James E. Alexander late of said county, deceased and moves the court to admit the said Will to probate and to issue Letters Testamentary on the said estate to the said Louisa Alexander the Executrix in said Will. It is therefore ordered that a citation issue to any Sheriff of the State of Ala., commanding him to summon Louisa Alexander the widow of said James E. Alexander, deceased, requiring her to appear at the next term of this court to be held on the 15th day of October 1868 and show if she has anything to allege against said application, why the same should not be granted and the said Will admitted to probate and letters issued thereon to the said Louisa Alexander. A.D. Chandler, Judge of Probate _____________ State of Alabama, Cleburne County Probate Court October 15th 1868 Before the probate court of Cleburne County personally came Louisa Alexander who produces a paper purporting to be the Last Will and Testament of James E. Alexander, late of said county, deceased. Also appearing this day, D.V. Crider and W.J. Price, subscribing witnesses to said Will who being each duly sworn says that they were each present when said Will was signed by the said Jas. E. Alexander; that the signature to said will was signed by same Jas. E. Alexander in their presence and that he signed, published and declared the same to be his last will and testament and that the said testator at the time of the signing was of sound and disposing mind and over the age of twenty one years and that they and each of them signed and witnessed in his presence and in the presence of each other at his request. It is therefore ordered and decreed that the said Will of the said James E. Alexander, deceased, be admitted to probate as the Last Will and Testament of the said James E. Alexander, deceased and that the same be recorded and registered in this court. A.D. Chandler, Judge of Probate ____________ J.C. BARKER, ADMR. of ESTATE OF NANCY CHANDLER, Dec'd, ORDER TO SELL LANDS State of Alabama, Cleburne County October 29th 1868 After hearing the application of J.C. Barker, administrator of the estate of Nancy Chandler, late of said county, deceased for an order to sell all the property of said estate both real and personal for the payment of debts and distribution amongst the legal heirs of said decedent the law having been complied with and the depositions of F.W. Vaughan and Lemuel Edwards having been read in court setting forth that it is to the interest of the heirs and creditors that the entire estate of said decedent both real and personal be sold, it is therefore ordered by the court that J.C. Barker the administrator of said estate proceed to sell on the premises last occupied by the said Nancy Chandler, deceased, on the first day of December 1868 all the property of said estate both real and personal in twelve months time, except 12 1/2 percent on the sale of land to be paid in advance all the balance to be well secured by two or more good and sufficient securities. Chandler, Judge of Probate _____________ ORDER CONFIRMING SALE OF LANDS FROM ESTATE OF KELLET COKER, Dec'd State of Alabama, Cleburne County Probate Court December 1868 Term of Court Personally appeared, James Baber, Admr. of the estate of Kellett Coker, deceased, who after being duly sworn says that he exposed to sale and did sell on the 24th of October 1868 all the lands belonging to the estate of the said Kellett Coker, deceased and that H.C. Higgonbotham being the highest bidder became the purchaser at thirteen hundred and seventy five dollars and Nelson Higgonbotham and M.L. Pinson being the securities for the purchase money agreeable to an order made by the probate court of said county. James Baber, Admr. On this 17th day of December 1868 came James Baber, Administrator of the estate of Kellett Coker, deceased and presents the foregoing report of the sale of the lands belonging to said estate and it appearing to the court the the sale was fairly conducted and the lands bought at a fair valuation it is upon ordered by the court that said sale is hereby confirmed.
