S. P. Baber Judge of Probate and for said Cleburne County, Ala your petitioner Martha A. Pruitt respectfully represents unto your Honor that she is the widow of Tillman M. Pruitt, dec'd, and a resident of the county of Cleburne and State of Alabama, that her said husband, Tillman M. Pruitt departed this life interstate in Cleburne Co. Ala on the 9th day of May 1894, more than sixty days since and that there has been no Administration on his estate leaving surviving him your petitioner - his widow, minor children, to wit: Henry T. Pruitt, Mary J. Pruitt, and Minnie Pruitt and that the named at the time of his death situated in this State and County personal and real property not exceeding in value the amount exempt to widow and minor children as provided by the law that-is-to-say; he did not own over one thousand dollars worth of personal property __?___(and/or) real estate in area __?___ over one hundred sixty acres ? ? over two thousand dollars and She claims for herself and her said minor children herein named all of said property real and personal as exempt from administration and the payment of the debts of the said decedent. Therefore your petitioner? Your Honor to appoint his commissioners to set apart to her and her said minor children said personal and real property - as exempt from administration and the payment of the debts of said deceased as the law directs and make and grant all orders and proceedings necessary to be made and as in duty bound ? ever Mary A. Pruitt who being duly sworn says that the facts set forth in the foregoing petition is true to the best of her knowledge information and belief. Baber Judge of Probate Then there is this: Petition For Letters of Administration The State of Alabama Cleburne County In the matter of the Estate of Tillman Pruitt deceased To the Honorable A. A. Hurst, Judge of Probate Court Cleburne County. The petition of the undersigned L. J. Pruitt, respectfully represents that Tillman Pruitt departed this life at Beecham P. O. on or about the 9th day of May 1894 leaving no last will & Testament so far as your petitioner knows or believes, and that his death was known more than fifteen days before this day and this petitioner further shows? (knows) that the subj. (?) Tillman Pruitt was at the time of his death was an inhabitant of this county, Cleburne and died seized and possessed of Real and Personal Estate, in this State consisting cheifly of one hundred and sixty acres of land and household & kitchen furniture, & C & C all of said real and personal estate being estimated to be worth about four hundred dollars and probably not more, that the names, residence, ages, and condition of the only heirs, and distributees of the Estate of the said decedent so far, as your petitioner knows or believes are as follows, to wit: W. D. Pruitt, who resides in DeKalb Co. Ala,, P. C. Laye? J. B. Pruitt, and J. A. Pruitt each of whom reside in Floyd Co. Ga. Post Office Silver Creek, L. J. Pruitt and H. T. Pruitt, each of whom reside in Cleburne County Ala. P. O. Beecham each of above named are sons of deceased and are over the age of Twenty one years. Martha Ann Buttram a daughter of dec'd, wife of James Buttram who resides in Gordon Co. Ga. , and whose Post Office is unknown to petitioner, D. C. Alread, a daughter of dec'd, and wife of John Alread who resides in Haralson Co. GA. and whose Post Office is Beecham Ala., M. J. McWhorter, a daughter of the dec'd, wife of Henry McWhorter who resides in Cleburne Co. Ala. Post Office Beecham and who is under the age of Twenty one years. Minnie Pruitt a daughter of dec'd who resides in Floyd Co. Ga. P. O. Silver Creek, and is under the age of Twenty One years, and the children of M. J. Nix, deceased who was a daughter of deceased, and wife of J. W. Nix deceased viz: Fannie Nix, John H. Nix and Rosa Nix, last two named reside in Cleburne Co. Ala. Post Office Beecham and the first named resides in Floyd Co. Ga. Post Office Sliver Creek and each one under the age of Twenty one years. All of said heirs are of sound mind. That the others entitled have declined to Administer the said Estate; that your petitioner being a son of said deceased, an inhabitant of this State and over the age of Twenty one years and in no respect disqualified under the law from serving as an Administrator believing, that said Estate should be immediately Administered to the end, that the said property may be collected and preserved for those who shall appear to him? Legal right & interest, therein, (due or done) therefore by virtue of his right under the Statute? That your Honor will grant letters of Administration on said Estate to petitioner L. J. Pruitt upon his ? into bond in such sum as is required b the Statute, and with security or securities, as shall be affirmed by your Honor. The State Of Alabama Cleburne County L. J. Pruitt being duly sworn deposes and says that the facts? , in the above petition are true, according to the best of his knowledge, information, belief. Sworn to and subscribed to me this 22nd day of March 1899 A. A. Hurst Judge of Probate [Some time between 1894 and 1899 the mother Martha A. Pruitt died, most likely closer to 1899. The paperwork does not say. Then there was a slight tussle between the brothers L. J. Pruitt and W. D. Pruitt, This is an affidavit sworn to by L. J. Pruitt and brother H. T. Pruitt as to the ages, residence and conditions of minor heirs of estate of T. M. Pruitt. Filed in office ths June 26th, 1899 and signed by Edgar Johnson Register. This particular one is recorded in final record pages 200 and 201] The State of Alabama Cleburne County Before me, J. B. Stephens N. P. & Ex off J. P. in and for said County and State. personally appeared L. J. Pruitt and H. T. Pruitt who being, each duly sworn depose and say that J. B. Pruitt, A. J. Pruitt, Martha A. Buttram, D. C. Allred, Minnie Pruitt & Fannie Nix are each non-residents of the State of Alabama, and further that the defendants are each over the age of twenty-one years except said Minnie Pruitt who is under twenty-one years and over Fourteen years of age, and whose father and mother are both dead, and who has no Guardian and Fannie Nix who is a minor under Fourteen years of age, whos father and mother are both dead and who has no Guardian and said J. N. Pruitt who has no interest in the lands involved in this suit adverse to the interest of said Minnie Pruitt and Fannie Nix, and has the care, maintainance and custody of said Minnie Pruitt and Fannie Nix. Affiants further depose and say: that M. J. McWhorter who is under twenty-one and over fourteen years of age, whose father and mother are both dead, aand who has no Guartian and resides at Beacham Cleburne County Ala. and Rosa Nix a minor under fourteen years of age whose father and mother are both dead and she has no Guardian and resides with Henry McWhorter at Beacham Ala. and who has no interest in the lands involved in this suit adverse to the interest of said Rosa Nix and who has the maintainance and care of said Rosa Nix, and John H. Nix a minor under fourteen years of age whose father and mother are both dead and who has no Guardian and resides with H. T. Pruitt at Beacham Ala. and who has no interest in the land involved in this suit adverse to the interest of the said John H. Nix and who has the maintainance and care of said John H. Nix. Affiants further depose and say: That the facts set forth in the Second paragraph of Complainants Original Bill is the case of L. J. Pruitt vs W. D.
