Nov 10, 1869 I, Gilbert Gay of Cleburne County, Ala. having filed my application No. 2173 for an entry under theprovisions of the act of congress approved May 20, 1862 entitled " An Act to secure Homesteads to Actual Settlers on the Public Domain" do solemnly swear that I am the head of a family and a citizen of the United States; that said application No. 2173 is made for the purpose of settlement and cultivation and that said entry is for my exclusive use and benefit and not directly or indirectly for the use or benefit of any other person or persons whomsoever; and I have not heretofore had the benefit of this Act and that I am unable to visit the office at Montgomery by reason of Great Distance. Nov 10, 1869 I, Gilbert Gay of Cleburne County, Ala. do hereby apply to enter under the provisions of the Act of Congress approved May 20, 1862, entitled " An Act to secure Homesteads to Actual Settlers on the Public Domain" the E. 1/2 of SW 1/4 SW 1/4 of SE 1/4 and SE 1/4 of SW /4 of Section 35 in Township 16 of Range 12 E containing 163 72/100 acres. Anderson, Register of the Land Office, do hereby certify that the above application is for surveyed lands of the class which the applicant is legally entitled to enter under the Homestead Act of May 20, 1862 and that there is no prior, valid adverse right to the same. Nov 10, 1869 Received of Gilbert Gay the sum of four dollars and sixty five cents being in full for three acres and seventy two hundredths of E. 1/2 of SW 1/4, SW 1/4 of SE 1/3 and SE 1/4 of NW 1/4 Section No. Thirty Five in Township No. 16 S of Range No. Twelve being excess in said tract over the area entered under the Homestead Act per application and Receipt No. 2173. Wm. H. Dingley, Receiver. September 16, 1875 Final Proof Required Under Homestead Act May 20, 1862 We, Joseph R. Gentry and Samuel P. Skinner do solemnly swear that we have known Gilbert Gay for six years last past; that he is the head of a family consisting of a wife and children and is a citizen of the United States; that he is an inhabitant of the E 1/4 of SW ? SW 1/4 of SE 1/4 of NW 1/4 section No. 35 in Township No. 16 S of Range No. 12 East and that no other person resided upon the said land entitled to the right of Homestead of Pre-Emption. That the said Gilbert Gay entered upon and made settlement on said land on or before the 10th day of November 1869 and has built a house thereon and has lived in the said house and made it his exclusive home from before the 10th day of November 1869 to the present time and that he has since settlement, plowed, fenced and cultivated about 7 acres of said land and he has made the following improvements thereon to wit: A one room dwelling house 20 x 24 feet, kitchen 18 x 20 feet, wood shop house 18 x 20, Barn, Stable, and Black Smith Shop, vegetable garden, fruit orchard and a dug well. FInal Certificate No. 350 Application No. 2173 It is hereby certified that pursuant to the provisions of the Act of Congress approved May 20, 1862 entitled "An Act to secure homesteads to actual settlers on the public domain", Gilbert Gay has made payment in full for East half of SW quarter S West quarter of South East quarter and South East quarter of North West quarter of Section No. 35 in Township No. 16 South 12 East, 163 72/100 acres. Now therefore be it known that on presentation of this certificate to the Commissione of the General Land Office the said Gilbert Gay shall be entitled to Patent for the tract of land above described.
