Smith, who being duly sworn, deposes and says that while in the military service of the Confederate States, he was a Private in Company H of the 38th Alabama Volunteers; that while in the discharge of his duties as such on the 18th day of September 1863 at Chicamauga in the state of Georgia he was wounded in the right arm by a minnie ball, broke the bone and dislocated the elbow. And in consequence of such loss or wound, he is physically unable to earn a livelihood by labor. That his post office address is Methvin ?, Ala; that he is engaged in the business of farming. That his taxable property consists of 40 acres land value ??, 1 mule value $25. John S. Co. H and continued until captured at Ressecca, GA, then transferred to Co. K 38th Ala. Reenlisted as a Pvt. at Dalton, GA in the 38th Ala Reg. Co. H and continued until discharge in 1865. April 13, 1899 Application for the Relief of Confederate Soldiers and Sailors State of Alabama, Cleburne County To the Honorable Board of Pension Examiners for said County; Your Petitioner, John S. Smith, respectfully represents to your honorable board that he is a resident citizen of Cleburne County in the State of Alabama and that he resided in said State on the first day of January 1899. That he enlisted in the service of the State or Confederate States as a Private in Co. H in the 38th Ala Regiment on the __ day of October 1862 at Mobile in the State of Alabama and that he was honorably discharged by being paroled at Camp Morton, Ind., from such service on the 12th day of June 1865, that he did not desert the service of the Confederate States; that he was wounded at the Battle of Chicamaga in the State of GA. That he is now unable to make a living by manual labor on account of said wound in elbow joint of right arm; that he is at the time of filing this application 65 years of age, and that his postoffice address is Methvin ?, Alabama. That he does not own property either in his own name or that of his wife to the value of four hundred dollars; that his annual income does not exceed four hundred dollars; and that he has no children upon whom he can depend for support. Smith, whose name is signed to the foregoing application, and that I know of my own personal knowledge that the said John S. Smith did serve as set forth in his application, that he did not desert the service but was honorably discharged therefrom. J. R. Cole April 22, 1899 Affadavit of Witness State of Alabama, County of Cleburne I, S.C. Otwell, do solemnly swear that I am personally acquainted with John S. Smith, who name is signed to the foregoing application, and that I know of my own knowledge that the said John S. Also about 25 acres of land in culvitation. $100. 1 horse or mule $30. 1 watch, clock or jewelry $2.50 1 household and kitchen furniture $50. 1 old wagon $2. 1 set of farming tools or implements $1. John S. Smith (X, his mark) Affadavit of Physician and comments of Pension Examiner From a physical examination of this applicant Jno. S. Smith, I find he has enlargement of the knee joint and is of billious nature; has been wounded in the right arm below elbow which injures the use of his arm to same extent. I think him very well preserved for a man of his age of 65 years. T.J. Johns, M.D. This applicant Jno. S. Smith in response to oral examination says: I was in the Battle of Chickamauga, GA in 1863 and was wounded by open shot in the right arm, was sent to the hospital and rejoined my command at Dalton, GA in Jan 1864 and at the battle of Resacca, GA in May 1864 I was captured and was a prisoner of war at Camp Nortan ?? Ind. and was paroled June 12, 1865. " W.P.Howell , Pension Examiner July 1, 1911 State of Alabama, County of Cleburne Personally appeared, John S. Smith, who being duly sworn deposes and says that he is now on the pension roll in Cleburne County in the Third Class; that he hereby makes application under the Act approved April 24, 1911 to be placed on the pension roll of the Second Class on account of his age; he being at the time of making this application over the age of 70 years; that he was born at Tennessee; that he depends soley upon his pension for support and maintenance; that he is unable to procure any other positive proof of his age; as there is no none in this part of the country who can testify as to his birth. Jno. S. Smith (X, his mark) July 1, 1911 Affadavit of Witness State of Alabama, County of Cleburne I, M.D. Robinson, do solemnly swear that I am acquainted with Jno. S. Smith, whose name is signed to the foregoing application, and that I have known him for 15 years, that from personal knowledge of him and his general appearance, I believe that he is over seventy years of age. Smith was born in Dogwood, Tennessee on Jan 10, 1834. He was in the Civil War from 1862 until 1864 where he was wounded by a Minna ball in the right arm in the Battle of Chickamauga in Georgia. While in Georgia, he married Frances Elizabeth Ham. Frances was a Cherokee Indian. John and his family lived in a two room log home on forty acres of land in Cleburne County. He was a farmer with about 25 acres in cultivation. John died on Feb 6, 1917 and Frances died on Nov 23, 1903. They are both buried at Pleasant Grove Methodist Church Cemetery in Cleburne County."
