All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Hutchins July 25, 2006, 2:12 pm Source: Cleburne County Courthouse Written: 1905 State of Alabama Cleburne County IN THE NAME OF GOD AMEN I, Elcane Haywood, of the County of Cleburne, State of Alabama, do hereby make, publish and declare this my last will and testament, hereby revoking all other wills heretofore made by me. 1st I will and direct that my body be buried at Liberty Hill Church, in a decent and Christian-like manner, and a tomb be placed over my grave to mark my last resting place. 2nd I will and direct that all my burial expenses, and the expenses of my last sickness be first paid out of my estate, and all of my just debts be paid as soon as practicle. 3rd I give and bequeath to my beloved son, Alfred Haywood, my saw-mill and lath mill and boiler and one bed-stead. 4th I give and bequeath to my beloved son, Frank Haywood, the South-West 1/4 of the North East quarter of Section Two (2), Township seventeen (17) of Range nine (9), and one six (6) boiler and engine, and one set of blacksmiths tools, and one half interest in mower, one dining table, one trunk, one bed-stead, one large bible, one clock, one saddle, one lot of carpenters tools, one set of 16 inch mill stones, one grain scythe, and one wooden safe. 5th I give and bequeath to my son, Thomas Haywood, one 12 horse central city engine, one 44 inch circular saw, and one press screw and nut, one set of mill stones, one separator, and my interest in mower, one walnut folding table, one trunk, one bed-stead, one acme harrow, one cotton seed planter, one side board, and the South East 1/4 of the North-West quarter of Section Two (2), Township Seventeen (17) Range Nine (9). 6th I give and bequeath to my son William Haywood, one note which I hold against him, the face of said note calls for seventy-five dollars, besides the interest thereon, and I give to him five dollars in money. 7th I give and bequeath to my grandson Alex McKey, five dollars in money, I having given to his mother and father eighty-three 50-100 dollars to enter land and to buy supplies which was advanced to her out of my estate. I direct that said Alex McKey have no further interest in my estate. 8th I give and bequeathe to my daughter, Sarah Maddox, one feather bed, two quilts and one counter pane. 9th I give and bequeathe to my daughter, Amanda Tennison, one bed, two quilts and one third interest in the North West 1/4 of the North East quarter of Sec. two, Township 17, Range 9, the remaining two thirds of said North West 1/4 of the North East quarter of said Sec. two, to be equally divided between my sons Frank and Alfred Haywood. 10th I give and bequeathe to my daughter Judah A. Massy, one bed, two quilts, and one counter pane. 11th I give and bequeathe to my beloved wife, Elizabeth Haywood all the supplies and agricultural products that I may have at the time of my death and all the crops growing on my lands at the time of my death, also all the pillows and coverlets, one cow and calf, one small table, one cook stove, one bedstead, one bed spring, one spinning wheel, and the North East 1/4 of the South West quarter, of Section two (2), Township seventeen of Range 9, also one tin safe, four blankets and one cot. 12th I will and direct that after paying my debts and burial expenses out of the remainder of my property not disposed of by former paragraphs of this my will, that the same or the proceeds of the same be equally divided between my wife Elizabeth Haywood, Thos. Haywood, Alfred Haywood and Frank Haywood, share and share alike. 13th I hereby nominate, constitute and appoint my son Thomas Haywood with my wife, Elizabeth Haywood, jointly as my executors, of this my last will and testament, and it is my will that they execute the same without giving any bond. In witness whereof, I have this the 1st day of April, in the year of our Lord 1905, set my hand and affixed my seal, in the presence of these witnesses. E. Haywood.
