W. Ligon Judge This day came Presley Tharp into open court and produces a paper writing purporting to be the last will and testament of Hezekiah Tharp late of said county deceased, and also files this petition in writing and under oath, alleging that said decedent left at his death surviving him his widow Nancy Tharp, andlaos the following named children to wit: Robert Tharp. Nancy Vandiver wife of Henry Vandiver, Rufus Tharp, James Tharp, Permelia A. Pennington, wife of John Pennington and Mary Tharp a grand daughter of deceased all of whom are of full age and reside in the County of Colbert in the State of alabama and that there are other children and grand children of decedent that are non residents of the State of Alabama whose names and ages are not remembered by Petitioner and prays that a day be set oc the ______considered. It is therefore ordered that the seventh day of April 1873 be appointed a day in which to hear said petition, and that Notices issue to the widow and next of kin notifying them of the filing and of the day set to hear said petition and ordered further that notice issue to T. T. McCorkle and James W. Ligon the subscribing witnesses to said paper be and appear by the Probate on the said 7th day of April 1873 and give evidence testimony they witnessed the execution of said paper writing purporting to be the last will and testament of the said Tharp decd. And ordered furhter that W. L. McCleskey who is not of kin to the petitioner nor in any interested in his proceding be and he is hereby appointed Guardian ad interim for and to protect the interests of Better Tease on the haring of this cause and that he be duly notified as to law ______.
