Becton of the city of Selma, County of Dallas, and the State of Alabama, being of sound mind and disposing memory, and aware of the uncertainty of life and the certainty of death do make and publish this my last will and testament hereby revoking all other wills heretofore made by me – as follows, to wit: 1st I wish and direct my Executor to pay out of my Estate, all of my just debts as soon as may be convenient after my death. 2nd My wife, Maria L. Beaton, having left my bed and board and filed a bill against me for a divorce, and being advised that in case of my death during her lifetime, she would be entitled by the laws of Alabama to a portion of my estate. I hereby direct my Executor, as soon after the expiration of eighteen months from the date of his qualification as such, as may be practicable, to cause to be set apart and allowed to her by the proper court, such portion and such portion only of my real and personal estate, as she would have been entitled to in case of my death without having made any will and to deliver the same to her. 3rd All of the rest and residue of my property of whatever kind and description, I will and bequeath to be equally divided among the following persons, to wit: first my niece Miss Caroline Soles on account of my attachment for her and her faithful mention to and while sick. Second Ben Edwards Becton, son of my half brother Briant E Becton of North Carolina and third Frederick S. Beaton; the two last named being now registered in the Probate Court of Dallas County as my adopted children. 4th For the purpose of making the division provided for in the last paragraph hereof, I direct and empower my Executor, so soon after the Se?? apart of the share of the said Maria L. Becton as above directed, as he may deem advisable, to sell all of the rest and residue of my real and personal estate for cash, and to divide the proceeds of such sale in accordance with the 3rd paragraph hereof. 4th {sic] I hereby appoint Dr James Kent of the city of Selma, Executor of this my last will and testament, and having simplicit confidence in his judgement and integrity, I desire and direct the he be allowed to execute the same without giving bond as such executor. In testimony whereof I have hereunto set my hand and seal on this 2nd day of February A.D. 1866. Signed, sealed and published F. S.
