Minter State of Alabama, Dallas County. I, R. R. Minter considering the uncertainty of this life, and being of sound mind and memory, make and publish this my last will and testament. - I desire that all my real and personal property be sold except my negroes and stock in the Alabama and Tennefsee River Rail Roads. My negroes, stock in the Alabama and Tennefsee river rail some money arising from said sale, and all money due or may become due my estate, will constitute my estate, which after the payment of all my lawful debts. I will and bequeath as follows: To my granddaughter, M.E. Thomas, I will and bequeath four fifths of one fifth to be free from the marital rights of her husband & should she marry; should she die leaving no child or children of her body nor decendants of child or children, then the property herein bequeathed her shall revert and become the property of my daughters M.P. Alexander, J. R. Bohannon and S.M. Drudell. - To A. Cambell my granddaughter I will and bequeath four fifths of one fifth to be free from the marital rights of her husband; should she die leaving no child or children of her body nor decendants of child or children; then the property herein bequeathed her shall revert to and become the property of my daughters, M.P. Alexander, J. R. Bohannon, and S.M. Drudell. - All the rest and residue of my estate I will and bequeath to my daughters M. P. Alexander, I. R. Bohannon and S. M. Drudell, to be free from the marital rights of their husbands. - I desire that my executors shall invest the money of each legacy in giving negroes and give to each legatee instead of money thinking they will be less likely to spend an estate of that kind. - My reason for not bequeathing my granddaughter S.A. Alexander some thing is that I gave during my life all she ought to have. I hereby appoint my Grandson R. M. Alexander sole executor of this my last will and testament. April 5, 1861. Robert R. Before me Jno. F Conoley, Judge of the said Court, personally appeared in open court H.L. Densler, who having been by me first duly sworn and examined, did & does despose & say on oath, that he together with Robt H King & W H Densler, are each subscribing witnesses to the instrument of writing and shown to him, and which purports to be the last will and testament of Robert R. Minter, decd, Late and inhabitant of this County, that said Minter since deceased, signed and executed said instrument on the day the same bears date, and declared the same to be his last will and testament - and that affiant set his signature thereto on the day the same bears date, as a subscribing witness to the same, in the presence of said testator, and the other witnesses that said testator was of sound mind and disposing memory, and in the opinion of deponent, fully capable of making his will, at the time the same was so made, as aforesaid, affiant further states, that said testator was, the full age of twenty one years and upwards. - Subscribed & Sworn to Before me this 31st H.
