Montague, Judge of Probate: The petition of James Meaders, who is over 21 years of age, and resident of Marshall County, Alabama, respectfully represents unto your Honor, that he, and Thomas Meaders, Alfred Meaders, Rufus L. Meaders, James M. Barton, Fraces E. Bull, Nancy J. Barton, Louis L. Barton, Robert Barton, Elizabeth C. Barton, Amanda E. Barton, and Arthur N. Meaders, Eddie D. Meaders, and Josephine L. Moore, Marvin Moore, and Roda A. Helms, William W. Moore, Florence Moore, and Lewis Moore, Albert Moore, Veda Moore, Pearl Grant, and Mary P. Meaders, William L. Meaders are as joint-owners of the following described real estate in Etowah County, Alabama, to wit: One hundred and twenty-three and ¾ acres more or less, described as follows: North half of his north-east quarter, south-east quarter of north-east quarter and a junction of three & ¾ acres more or less, off the north-west corner of the south-east quarter of north-east quarter. Rec. Nineteen Township Gen, Range four; that applicant, Thomas, Alfred, & Rufus L. Meaders, in over 214 yr old originally in Marshall County, Alabama, & . . . they invested in said county, James M. Barton, Frances E. Bull, Nancy J., Lewis L., Robert, Elizabeth C. & Amanda E. Barton, in [due] an undivided 1/7 of an individual 1/9 interest in said lands and reside in Hood County, Texas; Arthur N. Meaders & Eddie D. Meaders each own an individual ½ interest of an undivided 1/9 interest in said lands, each over 21 years old & residing in Marshall County, Alabama; Lewis J. Moore & Marvin Moore, each own an individual ½ interest of an undivided 1/9 interest in said lands, & reside in Cannon County, Texas & over 21 years old; Rhoda A. Helms, William W., Florence, Lewis, Albert, & Veda, Wayne & [unintelligible] Helms, each own an 1/7 interest of an 1/9 interest in said lands, all under 21 years old, except for Rhoda A. Helms, & William W. Moore, who are over 21, & all reside in the State of Texas; & ½ interest of 1/9 interest in said lands. That said property cannot be equitably partitioned or divided without a sale of the same, and that it would be to the interest of all said parties to sell the said property for the purpose of partition and division. Your petitioner, therefore, respectfully prays your Honor to decree the said property to be sold, and to make and issue all such orders as may be necessary to effect the sale thereof for the purpose of such division and Partition. To G.M.E. Mann, Esquire, of Boaz, in the State of Alabama, Greeting: Know ye, that we, reposing confidence in your integrity, skill and ability, have appointed you Commissioner to take the answers to the interrogatories and cross-interrogatories hereunto attached of Ignatius Chandler and George Ross, material witnesses for the petitioner in a certain cause or proceeding now pending and undetermined in our said Court of Probate, entitled as set forth in the caption hereof. And we do hereby authorize and empower you, the said Commissioner, to call and cause to come before you the said witnesses, at such time and place as you shall appoint, and their deposition on oath to take, touching their knowledge of the matters and things in controversy in said cause or proceeding; and the said depositions, when so taken by you, shall be subscribed by said witnesses, and the same you shall, together with this Commission, return to us, with all convenient speed; and you shall likewise certify the same to us, under your hands and seals, in all things fully and explicitly, how you have executed this Commission. Page 7: Note  Draft of Court Findings The State of Alabama Etowah County Probate Court Nov. 1900 In the matter of the petition of James Meaders to sell certain lands for division and partition amongst joint owners and of the amt. of their payments of the purchase money. This being the time appointed by the court to hear the response of the sale of certain lands is described as follows, to wit: North half of a north-east quarter, south-west quarter of north-east quarter and a quarter of three & ¾ acres more or less of the north-west corner of north-east quarter dec. Thirteen Township, Gen, Range four, Etowah County, Alabama, under and in . . . of an order of sale granted December 11, 1899 to sell said lands for partition amongst joint owners. Now comes James Meaders by his attys. Donrath & Martin and moves to lease to confirm the sale of said lands and to make an order authorizing A.A. Allison the Commissioner who sold said lands, to convey the issue to G.H. Ross, the purchaser . . . and having being no objection to the confirmation of the sale of said lands, and it being made to appear to the Court that said Page 8: Note  Continuation Page Commissioner has filed his release of said sale of said lands under oath on November 8, 1900, in this lease, and . . . ten days, expired in . . . a joint refund of sale and it involved appearing to the Court that said sale was . . . and that the lands sold for an amount not greatly less than its real value, and . . . it appearing to the Court that G.H. Ross became the purchaser of said lands and paid . . . in cash the sum of six hundred and forty-one dollars, it is therefore ordered, adjudged and decreed by the Court that said sale of said lands be & the same is . . . in all things confirmed. It is further ordered, adjudged and decreed by . . . A.A. Allison, Commissioner as above-said, make & execute to said G.H. Ross a deed to said lands. It is further ordered, adjudged and decreed by the Court that after distributing the expenses of the sale & the costs to the Court, to add fifteen Page 9: Note  Continuation Page Dollars attys’ fees paid Donrath & Martin, and fifty-nine dollars costs of Court & --- Commission for the sale of said lands, the bal[ance[--to be five hundred & thirty-two dollars to be divided amongst the joint owners of said lands according to . . . interests herein, to wit as follows. . . adjudged and decreed, that of said interest shall be paid by the . . . to James Meaders the sum of fifty-nine & 11/100, being his interest herein.
