Deposition of Ignatius Chandler, and George Ross, witnesses, sworn and examined under and by virtue of a Commission issued out of the Probate Court of Etowah County, of the State of Alabama, in a certain cause therein pending in the matter of James Meaders¡¦ petition to sell lands for division. The said Ignatius Chandler and George Ross, being duly sworn to speak the truth, the whole truth, and nothing but the truth, do depose and say as follows: 1st. To first interrogatory they say that the names, ages, and residences of the joint owners are correctly stated in the petition to the best of their knowledge and judgment. 2nd. J.H. Lovejoy, Judge of said Court: To the undersigned Commissioner, heretofore appointed by your Honor, to sell certain Real Estate, which is particularly set forth and described in the Commission which was issued and addressed to the undersigned by your Honor, and which Commission is hereto annexed and ferred to as a part of the Report: Respectfully reports and represents unto your Honor, that in pursuance of, and in strict accordance with, the directions of said Commission and the statutes in such case made and provided, he did, on the 20th day of October, 1900, at 12 o/clock, sell at public auction, in this County, the property described in said Commission, to G.H. Ross, who was the highest and best bidder for the same, for the sum of six hundred and forty-one dollars, that being the highest amount bid at said sale; that said sale was in all respects fairly conducted; and that said G.H. Ross has complied with the terms of said sale by the payment to the undersigned of the whole of said purchase money, in cash, which money being the proceeds of said sale, as directed by said Commission, for the purpose of being distributed among the parties interested who are named in said Commission, according to law, and the orders of this Court, and he pays said money. And said Commissioner, having fully complied with the directions of said Commission, begs leave to submit the foregoing to the judgment and further order of your Honor, as the report of his action in the premises. Uptain [?], who, being by me first duly and legally sworn, says on oath that, Mary Francis Moore is a daughter of Texann Moore who was a daughter of one F. Meaders and the person named in a certain deed in the Probate Court of Etowah County, Ala, as Francis L. Moore, and that Veda Burdy Moore is also a daughter of said Texann Moore, and is the person mentioned in a certain deed of said Case as Veda Moore, both being daughters of said Texann Moore and Monroe Moore.
