This indenture made and entered into 12th day of September in the year of our Lord one thousand eight hundred and sixty-three (1863) between Daniel Fowler and his wife Malissa, party of the first part, and James W. B. F. Price, party of the second part witnesseth that the said party of the first part for and in consideration of the sum of six hundred dollars ($600.00) to them in hand paid at and before the sealing and delivery of these presents by the party of the second part, receipt whereof is hereby acknowledged, both granted, bargained, sold and conveyed and (next word illegible) by these presents grant, bargain, sell and convey unto the said party of the second part and to his heirs and assigns forever to the following described lands, to-wit: The NW 1/4 of NE 1/4, SE 1/4 of NW 1/4 and SW 1/4 of NW 1/4, with the exception of twenty (20) acres, more or less, in the SE corner of the SW 1/4 of NE 1/4, (next word illegible), all in Section No. 2, Township No. 15 of Range No. 14 west containing one hundred (100) acres, lying and being in the County of Fayette and State of Alabama, together with all (next word illegible), the tenenets (?) and appurtenances thereto belonging or in (next word illegible) appurtaining and also all the estate, right, title, interest, claim or demand whatever of Daniel Fowler and his wife Malissa, the said party of the first part either in law or equity of in and to the above bargained premises and any part and parcel thereof to have and to hold to the said party of the second part, his heirs and assigns to the whole and only proper benefit and (next word illegible) of the said party of the second part, his heirs and assigns forever and the said party of the first part forever binds heirs, executors, administrators and assigns doth hereby covenant and will forever defend the title of the above bargained premises to J. W. B. Price, his heirs and assigns free from the claims or (next word illegible) of all and every person or persons whomsoever as also the claim of the general Government in testimony whereof the part of the first party hath hereto set their hands and affixed their seals this the 12th day of September 1863. Smith, an acting Justice of the Peace in and for said County, hereby certify that Daniel Fowler and his wife Malissa, whose names appear to the foregoing conveyance and who is known to me acknowledge before me this day that being informed of the contents of the conveyance, they executed the same voluntarily on the day the same bears date.
