This being the day to which was continued the matter of the final settlement of said estate, now comes JAMES K.P. WRIGHT the administrator thereof and moves the court to pass and allow his accounts as the same have been by him stated and filed; comes also DAVID R. CHURCH, who was heretofore appointed guardian ad litum to represent and protect the interests of M.T. ELLISON, the wife of WASH ELLISON and S.E. MCCORMACK, wife of JOHN MCCORMACK, the only minors interested in this settlement and in open court consents to act as such and proceeds to contest the said settlement: Whereupon, due notice of the nature of and of the time appointed to make this settlement having been given by advertisement in the "Scottsboro Citizen" for three successive weeks, a newspaper published in said county, it is shown to the satisfaction of the court that said administrator has received of the assets of said estate, the sum of four hundred and thirty dollars and twenty- seven cents and that he has paid out and expended in and about the costs and expenses of this administration and in the payment of the just debts of said decedent, the sum of two hundred and seventy six dollars and seventeen cents, leaving a balance in his hands for distribution of the sum of one hundred and fifty-four dollars and ten cents. And said accounts appearing to be full and correct, it is ordered, adjudged and decreed by the court that said accounts be and they are hereby in all things passed and allowed above stated. And it appearing that said intestate left her surviving as her only heirs at law the following named children to wit: J.K.P. WRIGHT, the administrator, SARAH E. BERRY, wife of CARROLL BERRY, Z.I. WRIGHT, ELIZA M. DISHAROON wife of DAVID J. DISHAROON, M.P. LATTURE wife of JAMES LATTURE, M.A. SHELTON, wife of WM. L. SHELTON, all of full age, M.T. ELLISON wife of WASH ELLISON and S.E. MCCORMACK wife of JOHN MCORMACK, both of whom are minors, and daughters of M.J. DISHAROON, deceased, who was a daughter of said intestate, and further that each share in said estate will amount to the sum of twenty-two dollars and one cent and the distributive share of the said M.T. ELLISON and S.E. MCCORMICK each will amount to the sum of eleven dollars. But is now shown to the satisfaction of the court that said administrator has paid to ELIZA DISHAROON, MARTHA P. LATTURE, MARGARET A. SHELTON, SARAH E. BERRY and Z.I. WRIGHT, each the sum of twenty-eight dollars, and seventy cents, and the same being in excess of their respective shares, it is considered that each of them have and recover nothing of the said J.K.P. WRIGHT as such administrator; that he has paid out in the support and maintenance and in such sums as were actually necessary for their comfort, the sum of fourteen dollars and thirty-five cents, to and for the said M.T. ELLISON and S.E. MCCORMACK, each, respectively. It is considered that they have and recover nothing of the said J.K.P. WRIGHT as such administrator and the amount of the said administrators distribution is retained by him. And the fees and charges in this behalf not being paid and the same having been placed to the credit of the said administrator, it is therefore ordered and judged and decreed by the court that the Judge of this Court for the use of the officers of court, have and recover of the said J.K.P. WRIGHT as such administrator, the sum of seventeen dollars and eighty-five cents for which let execution issue. It is further considered that upon the payment of said costs and taking the receipt of the said Judge, the said administrator be discharged from further liability in this by reason of said trust.
