H(?) Kirby dec'd Estate Application to sell land. To the Hon. M. P. Brown Judge of the Court of Probate of Jackson County Alabama. The petition of Clinton Kirby administrator and Anabella Kirby Administrator of the estate of Thomas J. H. Kirby deceased, respectfully shows unto your Honor, that described tract of land, to wit: the west end of the south west 1/4 of the south west 1/4 of section 11, T. 5, Range 5 east, containing about thirthy acres lying in Jackson County, Alabama. Your petitioners further show unto your Honor that said estate is considerably indebted, and that there is no personal property belonging thereto wherewith to pay such indebtedness and for the purpose of paying said debts it will be necessary to sell the above described piece of land. Your petitioners further show that the following named persons are the heirs and only heirs at law of said decedent, to wit: Anabella Kirby the widow and his three children, Elizabeth, Clinton, and Thomas J. H. Kirby, all of whom are minors under fourteen years of age, and are in the custody and under the control of their mother and have no general guardian, and all reside in Jackson County, Ala. In consideration of the facts above stated, your petitioners pray your Honor, to grant an order and decree authorizing and empowering them to sell the above described piece of land for the purpose of paying the debts of said estate, and to this end that all such proceedings, orders legally to effect such sale.
