Brown Judge of the Probate Court in and for said County and Sate. The petition for Francis Marion Rutherford and Thomas B. Wood: respectfully shows unto your Honor that more than eighteen months have elasped since they were appointed and qualified in this Court as administrators of the estate of James Rutherford deceased, during all which time they have diligently and to the best of their abilities. Administered in and upon the affairs of said estate: Your petitioners further state that within one month after said letters of administration was granted to them, they gave notice of their said appointment by publication thereof for six successive weeks in the Bellefonte Era , a newspaper published in said County a copy which cannot be produced caused by the late war and the destruction of the public files. Your petition further shows unto your Honor that in their opinion said estate no longer requires the continuance of an administration, wherefore they now hencewith file their accounts and vouchers for a final settlement thereof, Showing all the amounts with which they are justly chargeable, and it's payments which they are entitled to have allowed to them and each voucher duly numbered and all other written evidence which they have in support of said account. Your petitioners also herewith file for the purpose such final settlement, and last your Honor, may be enabled to make proper orders and decree's for a due distribution of the residue of said estate, two schedules each respectably marked A and B and praye the same may be referred to, and taken as part of this return, first being a Statement of the money belonging to Said Estate and for distribution arising out of the sales of decendents personal property: The second being an account showing several amounts paid to and for the heirs and distributers. The dates when, and the amounts paid to each. Your petition further states he has not at any time during his administration used the funds of said estate or any part thereof for his own benefit in any way whatever. Your petition further states that the heirs and distributers of deceased are his nine children to wit: William Rutherford who is of full age and resides in Franklin Co Alabama. Missouri who intermarried with Seiver Bolton, and resides in this County, Archibald Rutherford of full age and resides in this County. James C. Rutherford of full age and resides in Tishomingo Co. Mississippi, Francis Marion Rutherford of full age, resides in this County, Sarah who intermarried with David L. Starkley and resides in Mississippi, County, Unknown, Nancy who intermarried with Thomas B.Wood and resides in this County, George Seiber Rutherford of full age and resides in Mississippi, County unknown, Joseph W. Rutherford of full age and resides in Jackson Co. Alabama. Your petition praye your Honor that a day may be set for making such settlement: that notice of same may be given and published as is required by law, and that after statements said schedules, and said accounts vouchers and other written evidences have been duly audited, examined,and considered , Your Honor will pass and allow said account in such form as may appear just and right, and distribute said estate among those entitled, after deducting all proper usual and reasonable fee's, and as is my duty bound by; Francis Marion Rutherford Thomas B.
