Talley Jr. the administrator de bonis non of said estate for a final settlement of said estate. Now comes the said Talley and moves the court to proceed with said settlement and that his said account may be passed and allowed as the same has been by him filed as aforesaid. And also comes George L. Maples Guardian, his minor heirs of Rebeca Maples and William Maning, representing his minor children and John Jones all heirs and distributees of said estate. And it appearing to the satisfaction of the court that due notice of the nature of and the terms set to make such settlement has been given according to law and strictly in pursuance to the order of this court, made and entered in said estate, on the 19th day of November 1876. Also comes Jasper J. Jones who was heretofore duly appointed by the court to act as the Guardian ad litum to represent a minor child of John Berry deceased (name unknown) a minor interested in this proceeding and settlement now appearing and in open court consenting to act and proceeding to contest said settlement the court proceeds to hear the matters pertaining to said settlement and accounts. Whereupon it is shown by sufficient proof that said administrator has received of the assets of said estate for which he is properly chargeable the sum of three hundred and fifty four dollars and ninety nine cents $354.99/100. The same being the amt of a decree rendered against W.D. Parks and Jas. W. Parks as teh administrators of Hugh L. Parks on the settlement made in probate court of said Hugh L. Parks administration of said Berry's estate, and that he justly expended in and about the cost of this administration the sum of seventy four dollars and ninety five cents for which he is properly credited with, leaving a ballance of two hundred and eighty dollars and four cents, subject to distribution among those entitled. It is ordered adjudged and decreed by the court that said account be and the same is hereby passed and allowed as the same is stated above. And it appearing to the court that after paying all costs and charges due including the cost and charges and expense of this settlement there will remain of the balance of money aforesaid the sum of two hundred and eighty dollars and five cents to be divided among those entitled. And it appearing that said decedent left him surviving the following named heirs: S.K. Glover, L.V.C. Glover, and J.C. Glover, heirs of Susan Glover deceased who was a daughter of said decedent; Nancy Maples & Moses B. Maples minor heirs of Rebecca Maples decd. who was a daughter of said decedent, George L. Maples Guardian for said minors; heirs at law of Sarah Hall decd. a daughter of decedent to wit: William Hall of full age, Martha A. Hall, Nancy Branham last named are minors, represented by William Manning; heirs at law of Matilda Maning to wit: Susan J. Maning, W.G.W. Maning, J.C.C. Maning, all of full age, John A. Maning, Samuel Manning, Sarah E. Maning last are minors, represented by their father William Manning; William C. Bery a son of said decedent; Elizabeth Summers a daughter of said decedent; minor child of John Berry, name unknown. But it is now shown to the court that L.E. Lindsey the former administrator of said decedent paid to said Sarah Hall, William C. Berry, Matilda Manning and Eliz. Summers more than their distributive interest in said estate and it is now considered by the court that said distributees are not now entitled to any distribution from the fund now on hand, but it is further shown that the heirs of Rebeca Maples, and the minor heirs of John Berry and the heirs of Susan Glover have not received anything from said estate, except two dollars and thirty cents paid to G.L. Maples as the Guardian of Nancy & M. B. Maples. The court now proceeds to decide the said final ballance of money shown to be in said administrates has as follows, and render decrees therefore to wit to S.K. Glover the sum of thirty one dollars and thirty seven cents, to L.V.C. Glover thirty one dollars and thirty seven cents, J.C. Glover thirty one dollars and thirty seven cents, John Jones thirty one dollars and thirty seven cents, Nancy Maples thirty dollars and twenty cents, Moses B. Maples thirty dollars and twenty cents, minor heirs of John Berry, ninety four dollars and thirteen cents being one full share of said final ballance of money. It is therefore ordered and adjudged and decreed that the said S.K. Glover, L.V.C. Glover, and J.C. Glover do each have and receive of John B. Talley Jr. the sum of thirty one dollars and thirty seven cents each, that being their proper distributive share in said remaining estate. It is further ordered and decreed that George L. Maples Guardian of Nancy Maples have and receive of said John B. Talley Jr. thirty dollars and twenty cents, that being said Nancy's proper distributive share. It is further ordered and decreed that George L. Maples Guardian for Moses B. Maples have and receive of said John B. Talley Jr. the sum of thirty dollars and twenty cents. It is further ordered and decreed that said John Berry's minor child (name unknown) have and receive of John B. Talley Jr. the sum of ninety four dollars and thirteen cents. It is further ordered that said accounts ... be filed and recorded. Additional Comments: William Berry, born about 1795 in South Carolina, died about 1859 in Jackson Co., AL. This William Berry is quite often confused with the other William Berry in Jackson Co. who died about the same time - I'm not sure of the relationship between the two.
