File Manager - Lygia D. Cutts SEP 1999 This indenture made and entire of into this 15th day of July A.D. 1880 by and between J.V Gross & Jerusha Gross, his wife of the first part & James A. Morgan of the second part all of Jackson County, Alabama. Whereas the said J.V. Gross as administrator of the estate of Madison David dec'd did in presence of an order of the Probate court of Jackson County Alabama, sell the within described land belonging to said estate at public sale to the highest bidder for said J.V. Gross being the highest and best bidden the sale of said land was confirmed by the Probate Court and on the 25th day of November 1868 said Court made an order for said J.V. Gross to make a deed to one Nathaniel Wilborim to whom said Gross has bargained it. Wilborim failing to take land in the year 1871 said Gross sold said land to James A. Morgan for the sum of two hundred and fifty dollars which has all been paid to recipt whereof is hereby acknowledged in pursuance whereof the party of the first have this day bargained and sold & by these presents do sell. Convey & deliver unto this party of the second part in pursuance of an order of the Probate Court of Jackson County, Alabama granted 25th day of Nov 1868 all their title claim and interest in the said tract or parcel of land known and described as N.E. qr. of S.E. qr. & SE qr. of section (21) also a part of the west half of the South E. qr. of N.W. qr. of Section (1) one all in Township (6) six. Range (5) East containing ninety three & 1493 3/4 acres more or less. To have and to hold unto themselves, their heirs, executors and assigns to warrant forever, defend the title to the above described land, against the lawful title claim or demand of all persons whomsoever claiming. In testimony whereof the parties of the first part have hereunto set their names and affixed their seals this day and date first above written. John V. Gross & Jerusha Gross his wife whose names are signed to the forgoing conveyance & who are known to me acknowledge before me on this day that being informed of the conveyance they executed the same voluntarily on the day the same bears date, and I further certify that the said Jerusha Gross known to me to be the wife of John V. Gross being examined by me separate and apart from her husband touching her signature, acknowledged that she signed the same without fear com- pulsion or coresion on the part of her husband.
