Nothing doubting but at the general resurrection I shall receive the same again by the Almighty power of God; and as touching such worldly estate wherewith it has pleased God to bless me in life, I give and demise (devise) and dispose of the same in following manner and form: That is to say, I make, constitute, order and appoint Cassandra McCutchen and William Walker McCutchen my sole executrix and executor of this my last will and testament and do ordain that all the extate of which I may died possessed and have not otherwise devised shall be sold and the proceeds divided equally between my legal heirs and their representatives except my said grandson William Walker McCutchen and Cassandra McCutchen and I do utterly disallow, revoke, and disannul all and every other former testaments, wills, legacies, bequests and executors by me in any wise before named will and bequeathed ratifying and confirmin this and no other to be my last will and testament wereof I have hereunto set my hand and seal this fourth day of February one thousand eight hundred and thirty four. John McCutchen Witness John H. Gray Filed in Chancery Record of Madison County, Alabama 1851. Will was contested June, 1854. States that the heirs of John McCutchen, who died in Jackson County, Alabama are: Cassandra McCutchen, the widow and relict; Joseph McCutchen (Jackson County), John D. And Joshua McCutchen (Madison Co.); sons, and Celia Riddle, wife of Richard Riddle, who is a daughter and Anne Phlemister (Finnister on marriage record), all of Illinois and William (called Walker) McCutchen, only child of said John McCutchen's son, William W. McCutchen deceased. States Cassandra married John McCutchen in 1822, she then being about 36 years of age and he 68. No issue living. Deed of gift from John McCutchen to wife, Cassandra McCutchen. 26 July 1835. Witness: John H. Gray Deposition of John McCutchen; states that John H. Gray is Cassandra's brother and that the deed of gift is a fraud. Deposition of Joseph McCutchen Deposition of walker McCutchen states that his grandfather married in 1822 or 1823 in Morgan County, ALa. That he, Walker McCutchen was left an orphan child and was reared by his grandfather, John McCutchen. John H. Gray now of Arkansas. States that Cassandra died in 1842. Heirs unknown. January 1854.
