T. Ware for Letters of Administration upon the estate of Jeptha M. Ware deceased. To the Hon. Jp. P. Stiles, Judge of Probate of said County: The petition of the undersigned G. T. Ware respectfully represents that Jeptha M. Ware departed this life in Jefferson Co. on or about the 23rd day of April 1901 leaving no last will and testament, so far as your petitioner knows or believes, and that his death was known more than fifteen days before this day; and this petition further shows that the said J. M. Ware was at the time of his death an inhabitant of this county and died seized and possessed of real and personal estate in this county consisting chiefly of real estate, all of said personal and real estate being estimated to be worth nine hundred dollars and probably not more; that the name, residences, ages and condition of the heirs and distributees of the estate of said decedent, so far as your petition knows and believes, are as follows, to-wit: [typed list of heirs glued to form. Handwritten insertions shown in parentheses] Petitioner, and M.J.Ware, J.L. Ware, Z.R. Ware, J.B. Ware, L.E. Ware, P.F. Ware all of whom are children of deceased, over 21 years of age and reside in Jefferson County Alabama, M. A. Cherry, wife of B. F. Cherry who is over 21 years of age and resides in Dallas County Alabama, Tom, Lou, Ellen, Nettie, Amanda (Bush wife of Horli(ss?) Bush McCalla Ala) and Rose (Thompson wife of Robert Thompson)Abernathy, children of Martha Abernathy, deceased and grand children of said intestate all of whom are over twenty one years of age and reside in Jefferson County Alabama, Berry Abernathy son of said Martha Abernathy, over 21 years of age and resides some where in the State of Texas, but whose particular place of residence is unknown to petitioner, Fred, Beattrice[sic], Ida (Pitts wife of J. Pitts), Jim and Mattie May (and Rosa Bell) Ware who are the children of T. C. Ware, deceased, and grand children of said intestate all over 21 years of age except Mattie May (and Rosa Bell) who are over 14 and reside in Jefferson County Alabama, and Ada, H.B., Grace and Moss Ware who are the children of S. R. Ware, deceased and grand children of said intestate the first two of whom are over 21 years of age and the last two over the age of 14 years all of whom reside in Jefferson County Alabama. That your petitioner, being a son of said deceased, an inhabitant of this State, above the age of twenty-one years and in no respect disqualified under the laws fromserving as an administrator, believing that the said estate should be immediately administered to the end that the said property may be collected and preserved for those who shall appear to have a legal right or interest therein, does, therefore, by virtue of his right under the statute, pray that your Honor will grant Letters of Administration on said estate to him upon his entereing into a bond insuch sum as is required by the stattue, and with security or securities to be approved by your Honor.
