Ware Deceased. To the Hon. J. P. Stiles Judge Probate Court said County: The undersigned G. T. Ware your petitioner, by appointment of this Court Administrator of the estate of said Jeptha M. Ware deceased, would respectfully represent unto your Honor, that the said deceased died seized of the surface rights in & to the following described lands situated in said County and State, to-wit: NE 1/4 of SW 1/4 & NW 1/4 of NE 1/4 of Section 35 Township 14 Range 4 West, also all the land now belonging to the estate of said deceased lying in the SE 1/4 of SW 1/4 of said Section 35, the same being fifteen acres more or less & lying west of the Landrum Branch & north of the creek running through said forty, also all the land now owned by the estate of said deceased in the SW 14/ of SE 1/4 of said Section 35, the same being thirty two acres more or less & lying east of the creek running through said forty. Your petitioner further sates that the names, ages, residences and condition of the heirs and distributees of said estate are as follows, to-wit: Your petitioner G. T. Ware, M.J. Ware, J.L. Ware, Z.R. Ware, J.B. Ware, L.E. Ware, P.F. Ware, Thomas Abernathy, Lou Abernathy, Ellen Abernathy, Nettie Abernathy, Amanda Bush wife of Horliss(lin?) Bush, Rose Thompson wife of Robert Thompson, Fred Ware, Beatrice Ware, James Ware, Ada Ware, & H.B. Ware, all residing in Jefferson County Ala & all over 21 years old, M.A. Cherry wife of B.F. Cherry both over 21 years old & residing in Dallas County Ala, Mattie May Ware, Rose Belle Ware, Grace Ware & Moss Ware, under 21 years & over 14 years & residing in Jefferson County Ala, Berry Abernathy over 21 years old & residing in the State of Texas his post office address is unknown to petitioner, & Ida Pitts wife of J. Pitts both over 21 years old & residing in Jefferson County Ala; and that P.F. Ware, Z.R. Ware, L.E. Ware & M.J. Ware, four of the heirs and distributees of said estate have requested that a sale for division of said lands be made. He further alleges that the said lands cannot be equitably divided among said heirs and distributees without a sale thereof, and therefore, he prays that for the purpose of making such a division your Honor will grant an order directing your petitioner to sell the lands hereinbefore described, and make such further orders herein as may be by law required, and to your honorable Court may seem meet. These interrogatories were to be propounded to J. E. Couch and W. R. Speakman. It was regarding the land owned by Jeptha Ware as described above. It was signed by Geo. P. Bondurant, Guardian ad Litem. Notation on the bottom: 'P. H. Moon Esqr. of Birmingham Ala is suggested as a proper person to be appointed commissioner to take the testimony of said witnesses.
