Morrow Judge of the Probate Court for said County The petition[er] William L. Wear respectfully shows unto your Honor that the late Jacob Wear who was an inhabitant of this county at the time of his death, departed this life on the 8th of March 1872 (looks like 1842) in this county leaving a last will and testament duly signed and published by him and attested by P. D. Wear, John Kelly and J. D. Wear all of whom reside in this county, in which said will and testament your petitioner is named as executor thereof, which said will is herewith produced to your Honor and propounded (?) for probate and record in this Court. Your petitioner further states that the widow of said decedent is Mrs. Nancy Wear who resides in this county and is of full age and that the next of kin are his eleven children and his 8 grand children the children of John Wear who was his son and now deceased. vzi: [sic] Hulda Morrison and her husband Calvin C. Morrison, over twenty-one years of age and reside in the State of Mississippi post office not known. J. D. Wear. A.(?) Taylor, wife of J. L. Taylor all of whom are over twenty one years of age and reside in this county. Summer (Summers?) Wear. Beth(n?)a Wear. Mary Wear, all over fourteen and under twenty-one years of age and reside in this county. Florentine Wear. Julie Wear. Martha Wear. Marcus Wear and V(?)ina Wear under fourteen years of age and reside with their mother the said widow of decedent in this county. Lucretia P(inson?) wife of B. P(inson?) - (looks like Pewsa) – both of whom are over twenty one years of age and reside in the county of St. Clair in the State of Alabama. The 8 children of the said John Wear, vzi [sic]: Malissa Goodwin wife of Wesly Goodwin. H. B. Wear. F. G. Wear, all over twenty one and reside in this county. Caroline Prewit wife of Wesly Prewit, both over twenty one years of age and reside in Shelby County of this state. Jane Goolsby wife of James Goolsby, both of whom are over twenty-one years of age and reside in the State of Mississippi, post office not known. Laura Weems wife of James Weems, over twenty-one years of age. Arthur Wear, and Ellen Wear, both under twenty-one years of age and over fourteen, all of whom reside in this county. Now in consideration of the premises your petitioner prays that a day may be set for the hearing of this his petition, that subpoenaes may be issued to (bring?) in said subscribing witnesses to testify on such afforsaid day, and that due notice of this application may be given to said widow and next of kin of said deceased; and that (handwriting totally falls apart here. I think it says…) such other and further order may be had in the premises as may be necessary to effect the probate and record of said will according to law.
