Jno C. Morrow Jefferson County ) Judge of Probate for sd County The petition of W. C. Ewbank, General Admr. for the County of Jefferson aforsaid respectfully shows unto your Honor that Ruth Ware an inhabitant and resident Citizen of this County departed this life more than 40 days since & that said decedent left personal property which is now in this County. That said property is so circumstanced that the same ought to be administered upon but no administration has been granted therein nor has any other person applied for letters thereon, but on the contrary, all those entitled to administer as next of kin desire sd administration to be cast on petitioner as General Admr of this County. Petitioner further alledges that said Ruth Ware died intestate. In consideration of all which petitioner suggests to your Honor the necessity of an administration upon said Estate & requests that letters be granted to petitioner in order that said estate be saved from waste. Petitioner further states he is informed and believes that the following named persons they & they alone are the heirs & distributees of said estate to wit: 1. Malissa Crawford (daughter of decedent) wife of Wm. C. Crawford, residence Pontotoc Co Mi, P.O. Pontotoc – of full age. 2. Zadok Ware (son of decedent) full age – residence Hempstead Co Ark, P.O. Centreville. 3. Nancy Dickinson wife of James Dickinson (daughter of decedent) of full age – residence Dallas Co Ark, P.O. Calhoun. 4 Polly Ann Wood wife of Wm. Wood of full age – daughter of decedent, residence Dallas Co Ark, P.O. Calhoun. 5. Jeptha M. Ware of this County of full age & son of decedent. 6. The children of John Ware decd who was a son of decedent as follows – Clementine Rockett wife of M. R. Rockett of full age resident of this County, & Samuel Ware, Zadoc Ware, & Malissa Ware all over 14 & under 21 years old -- & Ruth Ware & John Ware under 14 years old. All of sd. minors reside with their mother the widow of sd. John Ware dec’d (Mrs. M. E. Ware) in this County & have no guardians. 7. The children of Elizabeth Abernathy dec’d (who was a daughter of decedent) wife while living of Starling Abernathy who residence is Dallas Co Ark P.O. Calhoun -- the names & ages of which children are unknown to petitioner. 8. The children of Amanda, dec’d, (formerly Amanda Ware) daughter of decedent whose first husband was S. H. Wood & whose second husband’s name is unknown to petitioner – children’s names as follows – George Wood, Rutha Ann Wood, John Wood, & another child by her first husband whose name is unknown & one by her last husband whose name is unknown. The ages & residences & guardians if any of sd children of Amanda are unknown to petitioner. All of which is respectfully submitted. Subscribed & sworn to this ) 28th day of August 1869 ) W. C. Ewbank Jno C. Morrow ) Judge of Probate ) Additional Comments: Elam Ware was not known at this time to the Administrator, but was found later. His name is written in on the final settlement papers, and his signed receipt for his share of the estate is in the original papers. He was in Pontotoc Co MS. On all original deeds and court papers, Starling Abernathy's name is spelled with an 'a', and is not Sterling. Under John's children, Melissa was included on this list, but is not on the final settlement papers. She died between the time this document was written and the date of the final settlement. However, the final settlement was written February 16, 1871. Her grave marker in Union Baptist Church Lipscomb area of Birmingham AL gives her death date as 1877. Possibly the marker was mis-read. W. C. Eubank signed his name with a 'u,' but many clerks wrote it in documents with a 'w.'
