Wife: Alice Children and ages in 1937: James 14 Emmett 12 Wilburn 10 Lillian 8 Lawrence 6 Betty Jo 4 Charles 3 Testimony of Alice, Emmett's wife of 14 years, and of the attending physician was that Emmett was working in knee-deep water in a mine, trying to get a car back on its rail. In the process, he cut/scraped his leg, but continued to work in the water which was drainage from various parts of the mine. This water contained, among other things, excrement from "the considerable number of mules kept there." It was the doctor's opinion that the tetanus later developed from the open wound being in the contaminated water. The insurance company refused to honor the contract, arguing that the tetanus could have been caused by factors away from Emmett's work. Thus the lawsuit. NOTE: The only Watts family I could find on earlier census records was the following: 1920 Jefferson County Alabama census: Sarah Watts 35 widow, b. AL, parents both b.VA, lived at the No. 8 Mine quarters. children: --on(?) Howard (looks like), son, 20? (simply couldn't read it, but surname was different from the following Watts children) Emmett Watts, son, 17? ** D--- Watts, son, 13 Joey R. Watts, son, 11 Alice M Watts, dau, 6 Samuel J Watts, son, 3 Clift-- (L?) Watts, son, 1 and in same household: Amanda Young, dau, 19 Jesse Young, son-in-law 26 children: Fanny M., granddau, 3 Eola?, granddau, 3 months ** - If the Emmett from the 1937 case was 39 when he died in 1936, he should have been born around 1897. So in 1920 he would have been around 23. The age of the Emmett on the 1920 census doesn't match that, so I'm not sure it's the same Emmett who later married Alice some time around 1922 and had a son also named Emmett, bc 1915.
