All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lanelle Hanke lhbham@yahoo.com August 5, 2005, 3:14 pm Written: February 25, 1834 Recorded: August 22, 1834 This Indenture, made this twenty fifth day of February in the year of our Lord eighteen hundred and thirty four between Robert Gallaway of the County of Shelby and State of Alabama & his wife Nancy of the one part, and Starling Abernathy of the County of Jefferson and State of Alabama of the other part Witnesseth that Robert Gallaway & his wife Nancy in consideration of the sum of three hundred and fifty dollars the receipt whereof is hereby acknowledged have granted, bargained, sold, released and confirmed, and by these presents do and each of them doth grant, bargain, sell, release and confirm unto the [said] Starling Abernathy, his heirs and assigns forever the East half of the North West quarter of Section twenty three in Township nineteen of Range four West, and also the East half of the South West quarter of Section twenty three in Township nineteen of Range four West, together with all and singular the hereditaments and appurtenances whatsoever to the same belonging or appertaining, and the reversion and reversions, remainder and remainders, rents and profits thereof, and every part and parcel thereof and also all the estate right title interest claim, property and demand whatsoever which the said Robert Gallaway and Nancy his wife, have or each of them hath, into or out of the said lands tenements, heriditaments and premises. To have and to hold the said lands tenements and hereditaments and all and singular theother the premises herein before mentioned with their appurtenances unto the said Starling Abernathy his heirs and assigns to his own proper use and behoof forever. And that the said lands tenements, hereditaments and premises now are and henceforth shall continue remain and be unto the said Starling Abernathy his heirs and assigns free and clear, and freely and clearly acquitted exhonerated [sic] and discharged of from and against all former and other gifts, grants, bargains, sales, mortgages, estates, titles, troubles, charges and incumbrances whatsoever had, made, done, committed, occasioned, permitted, or suffered by the Robert Gallaway or Nancy Gallaway his wife or by any person lawfully claiming or to claim from or under them or by their assent, act or procurement. And the said Robert Gallaway and Nancy his wife, his and her heirs all and singular the aforesaid lands, tenements, hereditaments, and premises, and every part and parcel thereof, unto the said Starling Abernathy, his heirs and assigns against the said Robert Gallaway and Nancy his wife, his or her heirs and assigns shall and will warrant and forever defend by these presents. Watrous Shelby County ) two of the Justices of the Peace for said County Personally appeared Robert Gallaway and acknowledged that he executed the foregoing deed for the consideration and purposes therein mentioned. And the Nancy wife of the said Robert having been examined by us apart from her said husband acknowledged that she freely executed the said deed without constraint or any improper influence on the part of her said husband.
