All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lanelle Hanke lhbham@yahoo.com August 5, 2005, 10:36 am Written: November 9, 1831 Recorded: April 24, 1832 This Indenture made this 9th day of November one thousand eight hundred & thirty one, Between Walter Towery of the County of Jefferson in the State of Alabama of the one part, and Isaac Barger of the County and State aforesaid of the other part Witnefseth, that the said Walter Towry (no ‘e’), for and in consideration of the sum of two hundred dollars to him in hand paid the receipt whereof is hereby acknowledged, hath this day bargained sold enfeoffed and conveyed, and by these presents doth bargain, sell, alien, enfeoff and convey unto the said Isaac Barger, all that certain tract or parcel of land lying and being in the County of Jefferson and State of Alabama, To wit, the West half of the North East quarter of Section twenty in Township nineteen of Range four West, containing seventy nine acres and ninety six hundredths of an acre, To have and to hold the above described lands with the tenements and appurtenances thereunto belonging or in anywise appertaining unto the said Isaac Barger, his heirs and assigns forever, and the said Walter Towery for his heirs executors and administrators doth warrant and will forever defend the title to the above described and hereby granted premises, unto the said Isaac Barger, his heirs and assigns from and against the said Walter Towery and all and every person or persons claiming or holding under him the said Towery, and also against the lawful title claim or demand of all and every person or persons whomsoever claiming or holding, by from or under the Government of the United States, In testimony whereof the said Walter Towery hath hereunto set his hand and seal the day and year above written ~ Signed sealed and delivered in the presents [sic] of Walter Towery {Seal} Jno. Wood {Seal} The State of Alabama) Personally appeared before us the undersigned and Jefferson County ) acting Justices of the Peace for said County, Malinda Towery wife of Walter Towery who on a private examination separate & apart from her said husband, acknowledged that she freely and voluntarily signed, sealed and delivered the foregoing deed without any fear, threats or compulsion of her said husband. In testimony whereof I have hereunto set my hand and affixed my seal this the 19th Nov 1831. her Jno B. Ayres (Seal) Malinda X Towry {Seal} James H. Grace Clerk Jefferson County ) of the County Court of said County, John B Ayres one of the subscribing witnesses to the foregoing deed, who being duly sworn deposeth and saith that he saw Walter Towery sign, seal, and deliver the same to Isaac Barger on the day and year therein mentioned; and that he this deponent and James H. Wood subscribed their names thereto as witnesses in presence of the said Towery, and in presence of each other. Given under my hand and seal this 24th Apl 1832. B. E.
