John Ware to Peter Downey

The State of Alabama )  This Indenture made 
 Jefferson County    )  the Sixth day of October
one thousand eight hundred and fifty one between John Ware of the first part of 
the State and County above named and Peter Downey of the same County and State 
of the second part, Witnesseth:  That for and in consideration of the sum of 
one hundred and fifty dollars to him in hand paid the receipt whereof is hereby 
acknowledged hath this day bargained and sold and by these presents do bargain 
and sell and enfeoff and convey unto the said Peter Downey of the second part 
and to his heirs and assigns forever the following described land viz. the 
North East qr of the South East qr of Section Twenty-five Township Eighteen of 
Range four West, with the exeption of that portion which lies north of the 
branch also all the land lying South of the branch, same Section Township and 
Range with the exception of two acres and a half deeded by Alexander English to 
Wiley Dickinson all in the Tuscaloosa Land District.
To have and to hold to the said party of the second part his heirs and assigns 
forever, together with all the rights privileges and appurtenances thereunto 
belonging and in any wise appertaining and the first party for himself his 
heirs and Executors and administrators do and by these presents will forever 
warrant and defend the title from himself his heirs & from all and every person 
or persons whomsoever.
  In Testimony whereof the said first party hath hereunto set his hand and 
affixed his seal this day and date above written, October 6th 1851.

       Jefferson County   )  Personally appeared before me Joab Bagby Judge of 
Probate in and for said County John Ware who acknowledged that he signed sealed 
and delivered the foregoing deed to the aforesaid Peter Downey on the day and 
date thereof.
       Given under my hand and seal this 24th day of July 1852.

December in the same year recorded in Deed Book Volume 11 Pages 107 & 108.
